     1  1    Amend Senate File 2107 as follows:
     1  2 #1.  By striking everything after the enacting
     1  3 clause and inserting the following:
     1  4    <Section 1.  NEW SECTION.  481A.40  URBAN DEER
     1  5 CONTROL.
     1  6    1.  As used in this section, unless the context
     1  7 clearly requires a different meaning:
     1  8    a.  "Municipality" means a city or county in this
     1  9 state.
     1 10    b.  "Urban deer control" means deer hunting with a
     1 11 bow and arrow on public or private land in a
     1 12 municipality, without charge, as authorized by a
     1 13 municipal ordinance, for the purpose of reducing or
     1 14 stabilizing an urban deer population in the
     1 15 municipality.
     1 16    2.  An owner of public or private land shall not be
     1 17 liable for loss arising from personal injury or
     1 18 property damage occurring as a consequence of allowing
     1 19 urban deer control on the owner's property.
     1 20    3.  A municipal ordinance which authorizes urban
     1 21 deer control shall allow participation in urban deer
     1 22 control only by trained volunteer bow hunters and
     1 23 shall include conditions intended to minimize the risk
     1 24 of injury to people and property.  An urban deer
     1 25 control ordinance is not effective until the ordinance
     1 26 has been approved by the department of natural
     1 27 resources.
     1 28    4.  A hunter who participates in urban deer control
     1 29 pursuant to this section shall be otherwise qualified
     1 30 to hunt deer in this state, have a hunting license and
     1 31 pay the wildlife habitat fee, and obtain a special
     1 32 urban deer control hunting license valid only for the
     1 33 dates, locations, and type of deer specified on the
     1 34 license.  Special deer hunting licenses issued
     1 35 pursuant to this section shall be available only to
     1 36 residents and shall cost the same as deer hunting
     1 37 licenses issued during general deer seasons.  The
     1 38 commission may establish procedures for issuing more
     1 39 than one license per person as necessary to achieve
     1 40 the purposes of urban deer control, and the cost of
     1 41 each additional license shall be ten dollars.
     1 42    5.  The commission shall adopt rules in accordance
     1 43 with chapter 17A necessary for the administration of
     1 44 this section.>
     1 45 #2.  Title page, by striking lines 1 and 2 and
     1 46 inserting the following:  <An Act relating to public
     1 47 and private landowners' immunity from premises
     1 48 liability during urban deer control hunts authorized
     1 49 by municipal ordinances.>
