     1  1    Amend the amendment, S=3292, to House File 816, as
     1  2 amended, passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  Page 25, by inserting after line 24, the
     1  5 following:
     1  6    <Sec.    .  Section 256.7, subsection 24, Code
     1  7 2005, is amended to read as follows:
     1  8    24.  Adopt rules on or before January 1, 2001, to
     1  9 require school districts and accredited nonpublic
     1 10 schools to adopt local policies relating to health
     1 11 services, media services programs, and guidance
     1 12 programs, as part of the general accreditation
     1 13 standards applicable to school districts pursuant to
     1 14 section 256.11.  This subsection shall be applicable
     1 15 strictly for reporting purposes and shall not be
     1 16 interpreted to require school districts and accredited
     1 17 nonpublic schools to provide or offer health services,
     1 18 media services programs, or guidance programs.>
     1 19 #2.  Page 26, by inserting after line 9, the
     1 20 following:
     1 21    <Sec.    .  Section 256.11, Code 2005, is amended
     1 22 by adding the following new subsection:
     1 23    NEW SUBSECTION.  9.  Unless a waiver has been
     1 24 obtained under section 256.11A, each accredited
     1 25 nonpublic school or school district shall have the
     1 26 following:
     1 27    a.  A media center in each attendance center
     1 28 accessible to students throughout the school day and a
     1 29 qualified school media services specialist who meets
     1 30 the licensing standards prescribed by the board of
     1 31 educational examiners and who is responsible for media
     1 32 center supervision.
     1 33    b.  An articulated sequential elementary=secondary
     1 34 guidance program for grades kindergarten through
     1 35 twelve and a guidance counselor who meets the
     1 36 licensing standards prescribed by the board of
     1 37 educational examiners.
     1 38    In determining the requirements of this subsection
     1 39 for an accredited nonpublic school, the department
     1 40 shall evaluate the accredited nonpublic school on an
     1 41 accredited nonpublic school system basis rather than
     1 42 on an individual accredited nonpublic school basis.
     1 43    Sec.    .  Section 256.11A, subsection 1, Code
     1 44 2005, is amended to read as follows:
     1 45    1.  Schools Accredited nonpublic schools and school
     1 46 districts unable to meet the standard adopted by the
     1 47 state board requiring each school or school district
     1 48 operating a kindergarten through grade twelve program
     1 49 to provide an articulated sequential elementary=
     1 50 secondary guidance program may, not later than August
     2  1 1, 1995 2005, for the school year beginning July 1,
     2  2 1995 2005, file a written request to the department of
     2  3 education that the department waive one or more of the
     2  4 requirement for requirements established in section
     2  5 256.11, subsection 9, that an accredited nonpublic
     2  6 school or school district have a media center and a
     2  7 qualified school media services specialist and that an
     2  8 accredited nonpublic school or school district
     2  9 operating a kindergarten through grade twelve program
     2 10 provide an articulated sequential elementary=
     2 11 secondary guidance program.  The procedures specified
     2 12 in subsection 3 apply to the request.  Not later than
     2 13 August 1, 1996 2006, for the school year beginning
     2 14 July 1, 1996 2006, the board of directors of a school
     2 15 district or the authorities in charge of a nonpublic
     2 16 school may request a one=year extension of the waiver.
     2 17    Sec.    .  Section 256.11A, subsection 2, Code
     2 18 2005, is amended by striking the subsection.>
