     1  1    Amend the amendment, S=3185, to House File 619, as
     1  2 amended, passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  Page 13, by inserting after line 19 the
     1  5 following:
     1  6    <Sec.    .  Section 903B.1, subsection 1, Code
     1  7 2005, is amended to read as follows:
     1  8    1.  A person who has been convicted of a serious
     1  9 sex offense may shall, upon a first conviction and in
     1 10 addition to any other punishment provided by law, be
     1 11 required to undergo medroxyprogesterone acetate
     1 12 treatment as part of any conditions of release imposed
     1 13 by the court or the board of parole.  The treatment
     1 14 prescribed in this section may utilize an approved
     1 15 pharmaceutical agent other than medroxyprogesterone
     1 16 acetate.  Upon a second or subsequent conviction, the
     1 17 court or the board of parole shall require the person
     1 18 to undergo medroxyprogesterone acetate or other
     1 19 approved pharmaceutical agent treatment as a condition
     1 20 of release, unless, after an appropriate assessment,
     1 21 the court or board determines that the treatment would
     1 22 not be effective.  In determining whether a conviction
     1 23 is a first or second conviction under this section, a
     1 24 prior conviction for a criminal offense committed in
     1 25 another jurisdiction which would constitute a
     1 26 violation of section 709.3, subsection 2, if committed
     1 27 in this state, shall be considered a conviction under
     1 28 this section.  This section shall not apply if the
     1 29 person voluntarily undergoes a permanent surgical
     1 30 alternative approved by the court or the board of
     1 31 parole.
     1 32    Sec.    .  Section 903B.1, Code 2005, is amended by
     1 33 adding the following new subsection:
     1 34    NEW SUBSECTION.  7.  A person who administers
     1 35 medroxyprogesterone acetate or any other
     1 36 pharmaceutical agent shall not be liable for civil
     1 37 damages for administering such pharmaceutical agents
     1 38 pursuant to this chapter.>
