     1  1    Amend House File 805, as amended, passed, and
     1  2 reprinted by the House, as follows:
     1  3 #1.  Page 8, by striking line 32, and inserting the
     1  4 following:
     1  5    <a.  For an open feedlot operation submitting an
     1  6 application for a construction permit on or after
     1  7 September 30, 2006, a nutrient management plan as
     1  8 provided in section>.
     1  9 #2.  Page 18, by striking line 15, and inserting
     1 10 the following:  <horizontally separated from the
     1 11 outside edge of the berm of the basin.  For an area of
     1 12 the basin where there is not a berm, the drainage tile
     1 13 line shall be rerouted at least fifty feet
     1 14 horizontally separated from the edge of the basin.>
     1 15 #3.  Page 18, by striking line 18, and inserting
     1 16 the following:  <nonperforated tile line shall be
     1 17 continuous and without connecting joints.>
     1 18 #4.  Page 18, by striking lines 34 and 35, and
     1 19 inserting the following:  <lines or other similar
     1 20 system.  However the following shall apply:
     1 21    (1)  Except as provided in subparagraph (2), an
     1 22 open feedlot operation shall not use a nongravity
     1 23 mechanical system that uses pumping equipment.
     1 24    (2)  If the open feedlot operation was constructed
     1 25 before the effective date of this Act, the operation
     1 26 may continue to use its existing nongravity mechanical
     1 27 system that uses pumping equipment or it may construct
     1 28 a new nongravity mechanical system that uses pumping
     1 29 equipment.  However, an open feedlot operation that
     1 30 expands the area of its open feedlot on or after April
     1 31 1, 2011, shall not use a nongravity mechanical system
     1 32 that uses pumping equipment.>
     1 33 #5.  By striking page 20, line 27 through page 21,
     1 34 line 4.
     1 35 #6.  By renumbering as necessary.
