Section 301.1, subsection 2, Code 2005, 1 6 is amended to read as follows: 1 7 2. Textbooks adopted and purchased by a school 1 8 district shall, to the extent funds are appropriated 1 9 by the general assembly, be made available to pupils 1 10 attending accredited nonpublic schools upon request of 1 11 the pupil or the pupil's parent under comparable terms 1 12 as made available to pupils attending public schools. 1 13 If the general assembly appropriates moneys for 1 14 purposes of making textbooks available to accredited 1 15 nonpublic school pupils, the department of education 1 16 shall ascertain the amount available to a school 1 17 district for the purchase of nonsectarian, 1 18 nonreligious textbooks for pupils attending accredited 1 19 nonpublic schools. The amount shall be in the 1 20 proportion that the basic enrollment of a 1 21 participating accredited nonpublic school bears to the 1 22 sum of the basic enrollments of all participating 1 23 accredited nonpublic schools in the state for the 1 24 budget year. For purposes of this section, a 1 25 "participating accredited nonpublic school" means an 1 26 accredited nonpublic school that submits a written 1 27 request on behalf of the school's pupils in accordance 1 28 with this subsection, and that certifies its actual 1 29 enrollment to the department of education by October 1 30 1, annually. By October 15, annually, the department 1 31 of education shall certify to the director of the 1 32 department of administrative services the annual 1 33 amount to be paid to each school district, and the 1 34 director of the department of administrative services 1 35 shall draw warrants payable to school districts in 1 36 accordance with this subsection. For purposes of this 1 37 subsection, an accredited nonpublic school's 1 38 enrollment count shall include only students who are 1 39 residents of Iowa. The costs of providing textbooks 1 40 to accredited nonpublic school pupils as provided in 1 41 this subsection shall not be included in the 1 42 computation of district cost under chapter 257, but 1 43 shall be shown in the budget as an expense from 1 44 miscellaneous income. Textbook expenditures made in 1 45 accordance with this subsection shall be kept on file 1 46 in the school district. Textbooks made available by a 1 47 school district to pupils attending accredited 1 48 nonpublic schools in accordance with this subsection 1 49 are not to be the property of the school district.> 1 50 #2.
