     1  1    Amend House File 440, as passed by the House, as
     1  2 follows:
     1  3 #1.  By striking everything after the enacting
     1  4 clause and inserting the following:
     1  5    <Section 1.  NEW SECTION.  714.7D  RETAIL MOTOR
     1  6 FUEL THEFT == MINIMUM PENALTIES.
     1  7    A person who is convicted of a simple misdemeanor
     1  8 under section 714.2, subsection 5, for theft of motor
     1  9 fuel from a retail dealer, as defined in section
     1 10 214A.1, is subject to the following, as applicable:
     1 11    1.  For a first offense, a fine of not less than
     1 12 two hundred dollars.
     1 13    2.  For a second or subsequent offense, a fine of
     1 14 not less than three hundred dollars and confinement in
     1 15 the county jail for a minimum of two days.>
     1 16 #2.  Title page, by striking lines 1 and 2 and
     1 17 inserting the following:  <An Act relating to the
     1 18 penalty>.
