     1  1    Amend Senate File 220 as follows:
     1  2 #1.  Page 1, by inserting after line 27 the
     1  3 following:
     1  4    <Sec.    .  Section 298.3, Code 2005, is amended by
     1  5 adding the following new unnumbered paragraph:
     1  6    NEW UNNUMBERED PARAGRAPH.  A school district shall
     1  7 only be authorized to utilize physical plant and
     1  8 equipment levy revenue for the purchase of software or
     1  9 payments under a software licensing agreement pursuant
     1 10 to subsection 3, for maintenance costs or repairing a
     1 11 building in preparation for sale pursuant to
     1 12 subsection 6, or for transportation repair,
     1 13 maintenance, or depreciation costs pursuant to
     1 14 subsection 9, if the department of management
     1 15 determines that the rate of property tax levied by a
     1 16 school district per one thousand dollars of assessed
     1 17 valuation for school funding purposes exceeds the
     1 18 statewide average rate of property tax levied by
     1 19 school districts per one thousand dollars of assessed
     1 20 valuation for school funding purposes.>
