     1  1    Amend the amendment, H=8361, to Senate File 2219,
     1  2 as passed by the Senate, as follows:
     1  3 #1.  Page 2, by inserting after line 49 the
     1  4 following:
     1  5    <#   .  Page 6, by inserting after line 12 the
     1  6 following:
     1  7    <Sec.    .  NEW SECTION.  730.6  RETALIATION FOR
     1  8 REPORT OF SEXUAL ABUSE OR SEXUAL HARASSMENT.
     1  9    1.  An employer shall not discharge an employee or
     1 10 take or fail to take action regarding an employee's
     1 11 appointment or proposed appointment or promotion or
     1 12 proposed promotion, or regarding any advantage of an
     1 13 employee, or make a report regarding the status of the
     1 14 employee as an unauthorized alien to any federal
     1 15 department or agency as a reprisal against an employee
     1 16 that made a report to a law enforcement agency that
     1 17 the employee has been a victim of sexual abuse or
     1 18 sexual harassment by another employee of the employer.
     1 19 A law enforcement agency that accepts a report of
     1 20 sexual abuse or sexual harassment as described in this
     1 21 subsection shall not make a report regarding the
     1 22 status of the victim as an unauthorized alien to any
     1 23 federal department or agency.
     1 24    2.  An employer who violates subsection 1 commits a
     1 25 simple misdemeanor.
     1 26    3.  A civil action for damages may be brought
     1 27 against an employer who violates subsection 1.>>
