     1  1    Amend House File 2282, as passed by the House, as
     1  2 follows:
     1  3 #1.  Page 2, by inserting after line 9 the
     1  4 following:
     1  5    <Sec.    .  Section 372.13, subsection 2, paragraph
     1  6 a, unnumbered paragraph 1, Code 2005, is amended to
     1  7 read as follows:
     1  8    By appointment by the remaining members of the
     1  9 council, except that if the remaining members do not
     1 10 constitute a quorum of the full membership, paragraph
     1 11 paragraphs "b" and "c" shall be followed.  The
     1 12 appointment shall be for the period until the next
     1 13 pending election as defined in section 69.12, and
     1 14 shall be made within forty days after the vacancy
     1 15 occurs.  If the council chooses to proceed under this
     1 16 paragraph, it shall publish notice in the manner
     1 17 prescribed by section 362.3, stating that the council
     1 18 intends to fill the vacancy by appointment but that
     1 19 the electors of the city or ward, as the case may be,
     1 20 have the right to file a petition requiring that the
     1 21 vacancy be filled by a special election.  The council
     1 22 may publish notice in advance if an elected official
     1 23 submits a resignation to take effect at a future date.
     1 24 The council may make an appointment to fill the
     1 25 vacancy after the notice is published or after the
     1 26 vacancy occurs, whichever is later.  However, if
     1 27 within fourteen days after publication of the notice
     1 28 or within fourteen days after the appointment is made,
     1 29 there is filed with the city clerk a petition which
     1 30 requests a special election to fill the vacancy, an
     1 31 appointment to fill the vacancy is temporary and the
     1 32 council shall call a special election to fill the
     1 33 vacancy permanently, under paragraph "b".  The number
     1 34 of signatures of eligible electors of a city for a
     1 35 valid petition shall be determined as follows:
     1 36    Sec.    .  Section 372.13, subsection 2, Code 2005,
     1 37 is amended by adding the following new paragraph:
     1 38    NEW PARAGRAPH.  c.  If concurrent vacancies exist
     1 39 on the council and the remaining council members do
     1 40 not constitute a quorum of the full membership, the
     1 41 city clerk shall notify the mayors of the cities in
     1 42 the county where the city is located and such mayors
     1 43 shall, within twenty days of notification, appoint a
     1 44 successor to each vacant city council office.  If the
     1 45 city is divided into wards, the appointee must be a
     1 46 resident of the ward in which the city council vacancy
     1 47 has occurred.  The appointee shall serve until
     1 48 qualification of the person elected at the special
     1 49 election provided for in paragraph "b".  If the office
     1 50 of city clerk is vacant, the remaining council members
     2  1 shall notify the mayors of the city council
     2  2 vacancies.>
     2  3 #2.  Page 2, by inserting after line 9 the
     2  4 following:
     2  5    <Sec.    .  NEW SECTION.  372.13A  PAYMENTS WITHOUT
     2  6 PRIOR AUTHORIZATION OF COUNCIL.
     2  7    1.  If concurrent vacancies exist on the council
     2  8 and the remaining council members do not constitute a
     2  9 quorum of the full membership, the city clerk is
     2 10 authorized to make the following payments without
     2 11 prior approval of the council:
     2 12    a.  For fixed charges including but not limited to
     2 13 freight, express, postage, water, light, telephone
     2 14 service, or contractual services, after a bill is
     2 15 filed with the clerk.
     2 16    b.  For salaries and payrolls if the compensation
     2 17 has been fixed or approved by the council.  The salary
     2 18 or payroll shall be certified by the officer or
     2 19 supervisor under whose direction or supervision the
     2 20 compensation is earned.
     2 21    2.  The bills paid under this section shall be
     2 22 submitted to the city council for review and approval
     2 23 at the next regular meeting following payment in which
     2 24 a quorum of the council is present.>
     2 25 #3.  Title page, line 1, by inserting after the
     2 26 words <relating to> the following:  <city government
     2 27 by providing for>.
     2 28 #4.  Title page, line 3, by inserting after the
     2 29 word <government> the following:  <and by providing
     2 30 for city continuity when concurrent city council
     2 31 vacancies exist>.
