     1  1    Amend the amendment, H=8025, to House File 2351 as
     1  2 follows:
     1  3 #1.  Page 1, by inserting after line 12, the
     1  4 following:
     1  5    <#   .  Page 4, by inserting before line 15, the
     1  6 following:
     1  7    <(3)  The use of eminent domain authority to
     1  8 acquire private property in the unincorporated area of
     1  9 a county for use as an airport, airport system, or
     1 10 aviation facilities is prohibited, notwithstanding any
     1 11 provision of the law to the contrary, if the property
     1 12 to be condemned is located outside the geographic
     1 13 boundaries of the city or county operating the
     1 14 airport, airport system, or aviation facilities or
     1 15 outside the geographic boundaries of the member
     1 16 municipalities of the commission or authority.
     1 17 However, an acquiring agency may proceed with
     1 18 condemnation of property under these circumstances if
     1 19 the board of supervisors of the county where the
     1 20 property for which condemnation is sought is located
     1 21 holds a public hearing on the matter and subsequent to
     1 22 the hearing approves, by resolution, the condemnation
     1 23 action.>>
