     1  1    Amend the amendment, H=1542, to House File 540, as
     1  2 amended, passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  Page 1, by striking lines 3 through 26, and
     1  5 inserting the following:
     1  6    <#      .  By striking everything after the
     1  7 enacting clause and inserting the following:
     1  8    <Section 1.  NEW SECTION.  321.267A  TRAFFIC
     1  9 ACCIDENTS INVOLVING CERTIFIED LAW ENFORCEMENT OFFICERS
     1 10 == REPORTS.
     1 11    1.  Any traffic accident involving the operation of
     1 12 a motor vehicle by a certified law enforcement officer
     1 13 shall be reported to the department by the officer's
     1 14 employer.  The officer's employer shall certify to the
     1 15 department whether or not the accident occurred in the
     1 16 line of duty while operating an official government
     1 17 vehicle.
     1 18    2.  Notwithstanding section 321.200, upon receiving
     1 19 a certification pursuant to subsection 1, the
     1 20 department shall not include a notation of the
     1 21 accident described in the certification on the
     1 22 officer's driving record.
     1 23    3.  The provisions of this section shall not
     1 24 relieve a certified law enforcement officer operating
     1 25 a motor vehicle of the duty to drive with due regard
     1 26 for the safety of all persons, and shall not protect a
     1 27 certified law enforcement officer from the
     1 28 consequences of the officer's reckless disregard for
     1 29 the safety of others.
     1 30    4. For the purposes of this section, "certified law
     1 31 enforcement officer" means a law enforcement officer
     1 32 who is certified through the Iowa law enforcement
     1 33 academy as provided in section 80B.13, subsection 3,
     1 34 or section 80B.17.>>
