     1  1    Amend the House amendment, S=3208, to Senate File
     1  2 200, as passed by the Senate, as follows:
     1  3 #1.  By striking page 1, line 8, through page 4,
     1  4 line 33, and inserting the following:
     1  5    <Sec.    .  NEW SECTION.  455B.118  WATERSHED
     1  6 IMPROVEMENT FUND.
     1  7    1.  A watershed improvement fund is created in the
     1  8 state treasury under the joint administrative control
     1  9 of the department of natural resources and the
     1 10 department of agriculture and land stewardship.
     1 11 Moneys appropriated to the fund and any other moneys
     1 12 available to and obtained or accepted by either
     1 13 department for placement in the fund shall be
     1 14 deposited in the fund.  Additionally, payments of
     1 15 interest, recaptures of awards, and other repayments
     1 16 to the fund shall be deposited in the fund.
     1 17 Notwithstanding section 12C.7, subsection 2, interest
     1 18 or earnings on moneys in the fund shall be credited to
     1 19 the fund.  Notwithstanding section 8.33, moneys in the
     1 20 fund that remain unencumbered or unobligated at the
     1 21 end of the fiscal year shall not revert, but shall
     1 22 remain available for the same purpose in the
     1 23 succeeding fiscal year.  Moneys appropriated to either
     1 24 department and deposited in the fund shall not be used
     1 25 for administrative purposes.
     1 26    2.  The purposes of the watershed improvement fund
     1 27 are the following:
     1 28    a.  Enhancement of water quality in the state
     1 29 through a variety of impairment=based, locally
     1 30 directed watershed improvement grant projects.
     1 31    b.  Positively affecting the management and use of
     1 32 water for the purposes of drinking, agriculture,
     1 33 recreation, sport, and economic development in the
     1 34 state.
     1 35    c.  Ensuring public participation in the process of
     1 36 determining priorities related to water quality
     1 37 including but not limited to all of the following:
     1 38    (1)  Agricultural runoff and drainage.
     1 39    (2)  Stream bank erosion.
     1 40    (3)  Municipal discharge.
     1 41    (4)  Stormwater runoff.
     1 42    (5)  Unsewered communities.
     1 43    (6)  Industrial discharge.
     1 44    (7)  Livestock runoff.
     1 45    3.  A watershed improvement review committee is
     1 46 established consisting of all of the following voting
     1 47 members, appointed by the named entity or entities and
     1 48 approved by the governor:
     1 49    a.  One member of the agribusiness association of
     1 50 Iowa.
     2  1    b.  One member of the Iowa association of water
     2  2 agencies.
     2  3    c.  One member of the Iowa environmental council.
     2  4    d.  One member of the Iowa farm bureau federation.
     2  5    e.  One member of the Iowa pork producers
     2  6 association.
     2  7    f.  One member of the Iowa rural water association.
     2  8    g.  One member of the Iowa soybean association.
     2  9    h.  One member representing soil and water
     2 10 conservation districts of Iowa.
     2 11    i.  One member of the Iowa association of county
     2 12 conservation boards.
     2 13    j.  One person representing the department of
     2 14 agriculture and land stewardship.
     2 15    k.  One person representing the department of
     2 16 natural resources.
     2 17    4.  The watershed improvement review committee
     2 18 shall do all of the following:
     2 19    a.  Award local watershed improvement grants and
     2 20 monitor the progress of local watershed improvement
     2 21 projects awarded grants.  A local watershed
     2 22 improvement grant may be awarded for a period not to
     2 23 exceed three years.  Each local watershed improvement
     2 24 grant awarded shall not exceed ten percent of the
     2 25 moneys appropriated for the grants during a fiscal
     2 26 year.
     2 27    b.  Assist with the development of monitoring plans
     2 28 for local watershed improvement projects.
     2 29    c.  Review monitoring results before, during, and
     2 30 after completion of a local watershed improvement
     2 31 project.
     2 32    d.  Review costs and benefits of mitigation
     2 33 practices utilized by a project.
     2 34    e.  By January 31, annually, submit an electronic
     2 35 report to the governor and the general assembly
     2 36 regarding the progress of the watershed improvement
     2 37 projects during the previous calendar year.
     2 38    f.  Elicit the expertise of other organizations for
     2 39 technical assistance in the work of the review
     2 40 committee.
     2 41    g.  Adopt administrative rules pursuant to chapter
     2 42 17A to administer this section.
     2 43    5.  A watershed improvement review committee member
     2 44 who also serves on a local watershed improvement
     2 45 committee shall abstain from voting on a local
     2 46 watershed improvement grant application submitted by
     2 47 the same local watershed improvement committee of
     2 48 which the person is a member.
     2 49    6.  a.  A local watershed improvement committee
     2 50 shall be organized for the purposes of applying for a
     3  1 local watershed improvement grant and implementing a
     3  2 local watershed improvement project.  Each local
     3  3 watershed improvement grant application shall include
     3  4 a methodology for attaining measurable, observable,
     3  5 and performance=based results.  A majority of the
     3  6 members of the local watershed improvement committee
     3  7 shall represent a cause for the impairment of the
     3  8 watershed.  The committee shall be authorized as a
     3  9 not=for=profit organization by the secretary of state.
     3 10 Soil and water conservation districts may also be
     3 11 eligible and apply for and receive local watershed
     3 12 improvement grants.
     3 13    b.  A local watershed improvement committee shall
     3 14 be responsible for application for and implementation
     3 15 of an approved local watershed improvement grant,
     3 16 including providing authorization for project bids and
     3 17 project expenditures under the grant.  A portion of
     3 18 the grant moneys may be used to engage engineering
     3 19 expertise related to the project.  The committee shall
     3 20 monitor local performance throughout the local
     3 21 watershed grant project and shall submit a report at
     3 22 six=month intervals regarding the progress and
     3 23 findings of the project as required by the watershed
     3 24 improvement review committee.>
