House Amendment 1457 PAG LIN 1 1 Amend House File 586 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 <Section 1. TASK FORCE == MEDICARE PART D 1 5 IMPLEMENTATION. 1 6 1. The department of human services shall convene 1 7 a task force to determine the most efficient means of 1 8 implementing the Medicare drug benefit established as 1 9 Medicare Part D under the federal Medicare 1 10 Prescription Drug, Improvement and Modernization Act 1 11 of 2003. The task force shall consist of all of the 1 12 following voting members: 1 13 a. The director of human services, or the 1 14 director's designee. 1 15 b. The director of the department of elder 1 16 affairs, or the director's designee. 1 17 c. The director of public health, or the 1 18 director's designee. 1 19 d. A representative of the area agencies on aging. 1 20 e. A representative of the AARP. 1 21 f. A representative of the governor's 1 22 developmental disabilities council. 1 23 g. A representative of the insurance division of 1 24 the department of commerce. 1 25 h. A representative of the national alliance for 1 26 the mentally ill Iowa. 1 27 i. A representative of the United States social 1 28 security administration. 1 29 j. A representative of the Iowa association of 1 30 homes and services for the aging. 1 31 k. A representative of the Iowa health care 1 32 association. 1 33 l. A representative of the Iowa state association 1 34 of counties. 1 35 m. A representative of the Iowa council of health 1 36 care centers. 1 37 n. Eight members of the general assembly. 1 38 2. a. The legislative members of the task force 1 39 shall be appointed by the republican and democratic 1 40 leaders of the senate, after consultation with the 1 41 president of the senate, and by the speaker of the 1 42 house of representatives, after consultation with the 1 43 majority leader and the minority leader of the house 1 44 of representatives. The legislative appointments 1 45 shall comply with sections 69.16 and 69.16A. 1 46 b. Vacancies on the task force shall be filled by 1 47 the original appointing authority and in the manner of 1 48 the original appointments. 1 49 3. The task force shall elect a chairperson. A 1 50 majority of the members of the task force shall 2 1 constitute a quorum. A majority vote of those members 2 2 present shall be required for any action of the task 2 3 force. The department of human services shall provide 2 4 staffing for the task force. 2 5 4. The task force shall make recommendations 2 6 regarding all of the following: 2 7 a. Issues related to low=income elderly and 2 8 individuals with disabilities who are enrolled in both 2 9 Medicaid and Medicare, or "dual eligibles", who will 2 10 no longer be eligible for coverage of prescription 2 11 drugs under Medicaid. 2 12 b. The extent to which the state will provide 2 13 benefits to wraparound Medicare Part D benefits. 2 14 c. Administration of the subsidy for low=income 2 15 beneficiaries. 2 16 d. General administration of the Medicare Part D 2 17 program throughout the state. 2 18 5. The task force shall submit a report of its 2 19 findings and recommendations to the oversight 2 20 committee of the general assembly no later than 2 21 October 1, 2005. 2 22 Sec. 2. EFFECTIVE DATE.
