1 1 Amend the amendment, H=1417, to House File 841 as
1 2 follows:
1 3 #1. Page 10, by inserting after line 11, the
1 4 following:
1 5 <Sec. . CASE MANAGEMENT FOR THE FRAIL ELDERLY.
1 6 1. The department of human services shall submit a
1 7 medical assistance state plan amendment to the centers
1 8 for Medicare and Medicaid services of the United
1 9 States department of health and human services to
1 10 provide for inclusion of case management for the frail
1 11 elderly as a medical assistance covered service. The
1 12 department of human services shall develop the medical
1 13 assistance state plan amendment in consultation with
1 14 the department of elder affairs.
1 15 2. If the medical assistance state plan amendment
1 16 is approved, the department of elder affairs shall use
1 17 existing funding for case management as nonfederal
1 18 matching funds. The department of elder affairs, in
1 19 consultation with the department of human services,
1 20 shall determine the amount of current funding that
1 21 would be eligible for use as nonfederal matching funds
1 22 so that sufficient funding is retained to provide case
1 23 management services for frail elders who are not
1 24 eligible for the medical assistance program.
1 25 The department shall establish a reimbursement rate
1 26 for case management for the frail elderly such that
1 27 the amount of state funding necessary to pay for such
1 28 case management does not exceed the amount
1 29 appropriated to the department of elder affairs for
1 30 case management for the frail elderly in the fiscal
1 31 year beginning July 1, 2005. All state and federal
1 32 funds appropriated or received for case management for
1 33 the frail elderly shall be used for services to
1 34 clients eligible for medical assistance. Any state
1 35 savings realized from case management for the frail
1 36 elderly shall be used to expand services to the frail
1 37 elderly.
1 38 3. The department of human services in
1 39 consultation with the department of elder affairs
1 40 shall determine whether case management for the frail
1 41 elderly should continue to be provided through a sole
1 42 source contract or if a request for proposals process
1 43 should be initiated to provide the services. The
1 44 departments shall submit their recommendation to the
1 45 general assembly by January 1, 2006.>
