     1  1    Amend House File 828 as follows:
     1  2 #1.  Page 3, by inserting after line 29, the
     1  3 following:
     1  4    <Sec.    .  Section 462A.12, subsection 11, Code
     1  5 2005, is amended to read as follows:
     1  6    11.  A person shall not operate a vessel within
     1  7 fifty feet of a diver's flag placed in accordance with
     1  8 the rules of the commission adopted under chapter 17A,
     1  9 or within fifty feet of a flag displayed when a person
     1 10 is in the water pursuant to section 462A.15,
     1 11 subsection 2.
     1 12    Sec.    .  Section 462A.15, Code 2005, is amended
     1 13 to read as follows:
     1 14    462A.15  WATER SKIS AND SURFBOARDS == WARNING FLAG.
     1 15    1.  No A person shall not operate a vessel on any
     1 16 waters of this state under the jurisdiction of the
     1 17 commission for towing a person or persons on water
     1 18 skis, surfboard, or similar device unless there is in
     1 19 such vessel a responsible person, in addition to the
     1 20 operator, in a position to observe the progress of the
     1 21 person or persons being towed.
     1 22    2.  This section subsection does not apply to a
     1 23 performer engaged in a professional exhibition or a
     1 24 person or persons engaged in a professional exhibition
     1 25 or a person or persons engaged in an activity
     1 26 authorized under section 462A.16.
     1 27    2.  A person operating a vessel, other than a
     1 28 personal watercraft, on any waters of this state under
     1 29 the jurisdiction of the commission shall display a red
     1 30 or orange flag measuring at least twelve by twelve
     1 31 inches whenever a person who has left the vessel is in
     1 32 the water.  The flag shall not be displayed when the
     1 33 person is being towed, but shall be displayed when the
     1 34 person enters or reenters the water.  The flag shall
     1 35 be visible for three hundred sixty degrees around the
     1 36 vessel when displayed.  This subsection does not apply
     1 37 to a vessel when it is moored or anchored.>
     1 38 #2.  Page 8, by inserting after line 27 the
     1 39 following:
     1 40    <Sec.    .  Section 805.8B, subsection 1, paragraph
     1 41 c, Code 2005, is amended to read as follows:
     1 42    c.  For operating violations under sections
     1 43 462A.12, 462A.15, subsection 1, sections 462A.24, and
     1 44 462A.34, the scheduled fine is twenty=five dollars.
     1 45 However, a violation of section 462A.12, subsection 2,
     1 46 is not a scheduled violation.>
     1 47 #3.  Title page, line 3, by inserting after the
     1 48 word <vessels,> the following:  <the operation of a
     1 49 vessel while a person is in the water,>.
