     1  1    Amend House File 619 as follows:
     1  2 #1.  Page 1, by inserting before line 1 the
     1  3 following:
     1  4    <Section 1.  NEW SECTION.  692A.2B  RESTRICTIONS ON
     1  5 RESIDENCY NEAR CHILD CARE FACILITIES OR SCHOOLS.
     1  6    1.  For purposes of this section, "person" means a
     1  7 person who is required to register under this chapter.
     1  8    2.  A person shall not reside within one thousand
     1  9 feet of the real property comprising a public or
     1 10 nonpublic elementary or secondary school or a child
     1 11 care facility.
     1 12    3.  A person who resides within one thousand feet
     1 13 of the real property comprising a public or nonpublic
     1 14 elementary or secondary school, or a child care
     1 15 facility, commits an aggravated misdemeanor.
     1 16    4.  A person residing within one thousand feet of
     1 17 the real property comprising a public or nonpublic
     1 18 elementary or secondary school or a child care
     1 19 facility does not commit a violation of this section
     1 20 if any of the following apply:
     1 21    a.  The person is required to serve a sentence at a
     1 22 jail, prison, juvenile facility, or other correctional
     1 23 institution or facility.
     1 24    b.  The person is subject to an order of commitment
     1 25 under chapter 229A.
     1 26    c.  The person has established a residence prior to
     1 27 July 1, 2005, or a school or child care facility is
     1 28 newly located on or after July 1, 2005.
     1 29    d.  The person is a minor or a ward under a
     1 30 guardianship.
     1 31    Sec.    .  Section 692A.5, subsection 1, paragraph
     1 32 h, Code 2005, is amended to read as follows:
     1 33    h.  Inform the person, if the person's residency is
     1 34 restricted under section 692A.2A, that the person
     1 35 shall not reside within two thousand feet of the real
     1 36 property comprising a public or nonpublic elementary
     1 37 or secondary school, or a child care facility.  After
     1 38 June 30, 2005, inform the person, if the person's
     1 39 residency is restricted under section 692A.2B, that
     1 40 the person shall not reside within one thousand feet
     1 41 of the real property comprising a public or nonpublic
     1 42 elementary or secondary school, or a child care
     1 43 facility.>
