     1  1    Amend the amendment, S=5312, to House File 2302, as
     1  2 amended, passed, and reprinted by the House, as
     1  3 follows:
     1  4 #1.  Page 15, line 45, by inserting after the word
     1  5 <boat.> the following:  <If the commission issues any
     1  6 additional licenses to conduct gambling games under
     1  7 this chapter in addition to the number of licenses
     1  8 issued as of January 1, 2004, such a license shall
     1  9 only be issued for a facility if the applicant
     1 10 facility will be located in a county in which no other
     1 11 facility is located and if the applicant facility will
     1 12 be located in a county that is not adjacent to a
     1 13 county that has a facility for which a license to
     1 14 conduct gambling games has been granted under this
     1 15 chapter, unless the commission determines that
     1 16 granting a license to an applicant to be located in a
     1 17 county adjacent to a county that has a licensee will
     1 18 not have an adverse impact on that licensee.  The
     1 19 applicant shall have the burden before the commission
     1 20 of establishing that granting a license shall not have
     1 21 an adverse impact on a licensee in an adjacent
     1 22 county.>
