     1  1    Amend House File 2552, as passed by the House, as
     1  2 follows:
     1  3 #1.  Page 2, by inserting after line 9 the
     1  4 following:
     1  5    <Sec.    .  Section 321.34, subsection 10,
     1  6 paragraph d, Code Supplement 2003, is amended to read
     1  7 as follows:
     1  8    d.  For purposes of this subsection, a person is
     1  9 considered to be retired if the person is recognized
     1 10 by the chief of the fire department where the
     1 11 individual served, and on record, as officially
     1 12 retired from the fire department.  Special
     1 13 registration plates with a fire fighter emblem shall
     1 14 be surrendered, as provided in subsection 12, in
     1 15 exchange for regular registration plates upon
     1 16 termination of the motor vehicle owner's membership in
     1 17 the paid or volunteer fire department, unless the
     1 18 person is a retired member in good standing.  The
     1 19 surviving spouse of a paid or volunteer fire fighter
     1 20 who died in the line of duty and who was issued
     1 21 special plates under this subsection may continue to
     1 22 use or apply for and use the special plates subject to
     1 23 registration of the special plates in the surviving
     1 24 spouse's name and upon payment of the annual
     1 25 registration fee.  For purposes of this section, "died
     1 26 in the line of duty" means a death, as described in
     1 27 section 100B.11, for the purpose of line of duty death
     1 28 benefits.>
     1 29 #2.  Page 5, by striking line 1 and inserting the
     1 30 following:
     1 31    <Sec.    .  EFFECTIVE AND RETROACTIVE APPLICABILITY
     1 32 DATES.
     1 33    1.  This Act,>.
     1 34 #3.  Page 5, line 3, by inserting after the word
     1 35 <applies> the following:  <retroactively>.
     1 36 #4.  Page 5, by inserting after line 4 the
     1 37 following:
     1 38    <2.  The section of this Act amending section
     1 39 321.34, subsection 10, paragraph "d", applies
     1 40 retroactively to March 1, 2004.  Notwithstanding the
     1 41 provision of this Act that repeals section 321.34,
     1 42 subsection 10, effective upon enactment, the state
     1 43 department of transportation shall administer the
     1 44 special fire fighter plates as though the amendment to
     1 45 section 321.34, subsection 10, paragraph "d", had
     1 46 taken effect prior to the repeal of section 321.34,
     1 47 subsection 10.>
