     1  1    Amend Senate File 432 as follows:
     1  2 #1.  By striking page 2, line 32, through page 3,
     1  3 line 21, and inserting the following:
     1  4    <2.  a.  An electric utility subject to this
     1  5 division, except a utility which that elects rate
     1  6 regulation pursuant to section 476.1A, shall not be
     1  7 required to purchase, at any one time, more than its
     1  8 share of one hundred five megawatts of power or
     1  9 generate at least the following percentages of its
     1 10 total annual Iowa retail electric sales from
     1 11 alternative alternate energy production facilities or
     1 12 small hydro facilities at the rates established
     1 13 pursuant to section 476.43:.  The board shall allocate
     1 14 the one hundred five megawatts based upon each
     1 15 utility's percentage of the total Iowa retail peak
     1 16 demand, for the year beginning January 1, 1990, of all
     1 17 utilities subject to this section.
     1 18    (1)  By December 31, 2004, four percent.
     1 19    (2)  By December 31, 2005, five percent.
     1 20    (3)  By December 31, 2006, six percent.
     1 21    (4)  By December 31, 2007, seven percent.
     1 22    (5)  By December 31, 2008, eight percent.
     1 23    (6)  By December 31, 2009, nine percent.
     1 24    (7)  By December 31, 2010, and annually thereafter,
     1 25 at least ten percent.
     1 26    b.  A maximum of two percent of each utility's
     1 27 total annual retail electric sales may be derived from
     1 28 alternate energy production facilities or small hydro
     1 29 facilities placed in service before January 1, 2004.
     1 30    c.  At least twenty percent of an electric
     1 31 utility's yearly percentage pursuant to the schedule
     1 32 in paragraph "a" shall be derived from small
     1 33 distributed generation.
     1 34    If a utility undergoes reorganization as defined in
     1 35 section 476.76, the board shall combine the allocated
     1 36 purchases of power for each utility involved in the
     1 37 reorganization.
     1 38    Notwithstanding the one hundred five megawatt
     1 39 maximum, the board may increase the amount of power
     1 40 that a utility is required to purchase at the rates
     1 41 established pursuant to section 476.43 if the board
     1 42 finds that a utility, including a reorganized utility,
     1 43 exceeds its 1990 Iowa retail peak demand by twenty
     1 44 percent and the additional power the utility is
     1 45 required to purchase will encourage the development of
     1 46 alternate energy production facilities and small hydro
     1 47 facilities.  The increase shall not exceed the
     1 48 utility's increase in peak demand multiplied by the
     1 49 ratio of the utility's share of the one hundred five
     1 50 megawatt maximum to its 1990 Iowa retail peak demand.>
