House Amendment 8422 PAG LIN 1 1 Amend House File 2558 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 <Section 1. Section 256.9, Code Supplement 2003, 1 5 is amended by adding the following new subsection: 1 6 NEW SUBSECTION. 53. Prepare and make available to 1 7 school districts and accredited nonpublic schools 1 8 courses of instruction that meet the requirements of 1 9 section 256.11, subsection 15. The director shall 1 10 develop a procedure for evaluating and measuring the 1 11 effectiveness of human growth and development, health 1 12 education, and family life curricula in each school 1 13 district and accredited nonpublic school, including 1 14 the setting of reasonable goals for reduced sexual 1 15 activity, sexually transmitted diseases, and 1 16 premarital pregnancy. 1 17 Sec. 2. Section 256.11, subsections 2, 3, and 4, 1 18 Code 2003, are amended to read as follows: 1 19 2. The kindergarten program shall include 1 20 experiences designed to develop healthy emotional and 1 21 social habits and growth in the language arts and 1 22 communication skills, as well as a capacity for the 1 23 completion of individual tasks, and protect and 1 24 increase physical well=being with attention given to 1 25 experiences relating to the development of life skills 1 26 and medically accurate and age appropriate human 1 27 growth and development. A kindergarten teacher shall 1 28 be licensed to teach in kindergarten. An accredited 1 29 nonpublic school must meet the requirements of this 1 30 subsection only if the nonpublic school offers a 1 31 kindergarten program. 1 32 3. The following areas shall be taught in grades 1 33 one through six: English=language arts, social 1 34 studies, mathematics, science, health, medically 1 35 accurate and age appropriate human growth and 1 36 development, physical education, traffic safety, 1 37 music, and visual art. The health curriculum shall 1 38 include medically accurate and age appropriate 1 39 information regarding the characteristics of 1 40 communicable diseases including acquired immune 1 41 deficiency syndrome. The state board as part of 1 42 accreditation standards shall adopt curriculum 1 43 definitions for implementing the elementary program. 1 44 4. The following shall be taught in grades seven 1 45 and eight: English=language arts; social studies; 1 46 mathematics; science; health; medically accurate and 1 47 age appropriate human growth and development, family, 1 48 consumer, career, and technology education; physical 1 49 education; music; and visual art. The health 1 50 curriculum shall include medically accurate and age 2 1 appropriate information regarding the characteristics 2 2 of sexually transmitted diseases and acquired immune 2 3 deficiency syndrome. The state board as part of 2 4 accreditation standards shall adopt curriculum 2 5 definitions for implementing the program in grades 2 6 seven and eight. However, this subsection shall not 2 7 apply to the teaching of family, consumer, career, and 2 8 technology education in nonpublic schools. 2 9 Sec. 3. Section 256.11, subsection 5, paragraph j, 2 10 unnumbered paragraph 1, Code 2003, is amended to read 2 11 as follows: 2 12 One unit of health education which shall include 2 13 personal health; food and nutrition; environmental 2 14 health; safety and survival skills; consumer health; 2 15 family life; medically accurate and age appropriate 2 16 human growth and development; substance abuse and 2 17 nonuse; emotional and social health; health resources; 2 18 and prevention and control of disease, including 2 19 medically accurate and age appropriate information 2 20 regarding sexually transmitted diseases and acquired 2 21 immune deficiency syndrome. 2 22 Sec. 4. Section 256.11, Code 2003, is amended by 2 23 adding the following new subsection: 2 24 NEW SUBSECTION. 15. All human growth and 2 25 development, health education, and family life courses 2 26 of instruction offered at grade levels six through 2 27 twelve that discuss sexual activity or behavior shall 2 28 satisfy the following conditions: 2 29 a. Information presented in course material and 2 30 instruction shall be medically accurate and objective. 2 31 b. All course materials and instruction shall be 2 32 age and developmentally appropriate. 2 33 c. Course materials and instruction shall include 2 34 the following: 2 35 (1) Parameters for a discussion of sexual 2 36 abstinence as a method to prevent unintended pregnancy 2 37 and sexually transmitted diseases such as HIV. 2 38 (2) Presentation of the latest medically factual 2 39 information regarding both the possible side effects 2 40 and health benefits of all forms of contraception. 2 41 (3) Discussion of the possible consequences of 2 42 unintended pregnancy and sexually transmitted diseases 2 43 such as HIV. The materials and instruction shall 2 44 stress the potentially serious hazards of sexual 2 45 activity or behavior. 2 46 (4) Statistics based on the latest medical 2 47 information citing the failure and success rates of 2 48 all contraceptive methods for the prevention of 2 49 pregnancy and sexually transmitted diseases such as 2 50 HIV. 3 1 (5) Provision for the development of positive 3 2 communication skills that support and maintain healthy 3 3 relationships and reject unwanted sexual activity. 3 4 (6) Emphasize a student's power to control 3 5 personal behavior. Students shall be encouraged to 3 6 base their actions on reasoning, self=discipline, 3 7 sense of responsibility, self=control, and ethical 3 8 considerations, such as respect for oneself and 3 9 others. 3 10 (7) Methods that teach students not to make 3 11 unwanted physical and verbal sexual advances and how 3 12 to reject unwanted sexual advances. The materials and 3 13 instruction shall cover verbal, physical, and visual 3 14 sexual harassment, including nonconsensual sexual 3 15 advances, nonconsensual physical sexual contact, and 3 16 rape by an acquaintance. The course materials and 3 17 instruction shall emphasize personal accountability 3 18 and respect for others and shall also encourage youth 3 19 to resist peer pressure. 3 20 (8) Shall teach that it is wrong to take advantage 3 21 of or exploit another person. 3 22 (9) Instruction in the potential legal 3 23 consequences of sexual assault under the Iowa criminal 3 24 code. 3 25 (10) Shall be free of racial, ethnic, and gender 3 26 biases. 3 27 (11) Shall teach students about counseling, 3 28 medical and legal resources available to survivors of 3 29 sexual abuse and sexual assault, including resources 3 30 for escaping violent relationships. 3 31 d. For purposes of this subsection, "HIV" means 3 32 the same as defined in section 141A.1. 3 33 e. "Medically accurate", as used in this section, 3 34 means supported by research conducted in compliance 3 35 with accepted scientific methods; recognized as 3 36 accurate and objective by leading professional 3 37 organizations and agencies with relevant expertise in 3 38 the field, which may include but shall not be limited 3 39 to the American college of obstetricians and 3 40 gynecologists and the centers for disease control and 3 41 prevention of the United States department of health 3 42 and human services; and published in peer=reviewed 3 43 publications where appropriate.> 3 44 #2.
