     1  2 #1.  Page 11, by inserting after line 1, the
     1  3 following:
     1  4    <Sec. ___.  Section 262B.1, Code Supplement 2003,
     1  5 is amended by striking the section and inserting in
     1  6 lieu thereof the following:
     1  7    262B.1  TITLE.
     1  8    This chapter shall be known and may be cited as the
     1  9 "University=Based Research and Economic Development
     1 10 Act".
     1 11    Sec. ___.  Section 262B.2, Code Supplement 2003, is
     1 12 amended by striking the section and inserting in lieu
     1 13 thereof the following:
     1 14    262B.2  LEGISLATIVE INTENT.
     1 15    It is the intent of the general assembly to provide
     1 16 support for mechanisms for encouraging the
     1 17 coordination of pure and applied research at the state
     1 18 board of regents institutions.  The purpose is to
     1 19 maximize and promote the economic benefit which may be
     1 20 derived from research.  This is to be done by
     1 21 increased coordination with the Iowa department of
     1 22 economic development and encouragement of the transfer
     1 23 of research results to the private sector.
     1 24    Sec. ___.  Section 262B.3, Code Supplement 2003, is
     1 25 amended by striking the section and inserting in lieu
     1 26 thereof the following:
     1 27    262B.3  ESTABLISHMENT OF CONSORTIUM.
     1 28    The board of regents or the universities under its
     1 29 jurisdiction shall establish consortiums for the
     1 30 purpose of carrying out the intent of this chapter.
     1 31 The majority of consortium members shall be from the
     1 32 university community and the balance of members shall
     1 33 be from private industry.  The members of the
     1 34 consortium shall be appointed by the president of the
     1 35 convening university and will serve at the pleasure of
     1 36 the president.
     1 37    Sec. ___.  NEW SECTION.  262B.4  DUTIES OF THE
     1 38 CONSORTIUM.
     1 39    1.  Each consortium shall assist the university in
     1 40 efforts to maximize the economic benefits outlined in
     1 41 section 262B.2.  More specifically, it shall assist
     1 42 the university by making recommendations for:
     1 43    a.  The development of strategies and materials
     1 44 useful in marketing university resources to out=of=
     1 45 state firms interested in an Iowa site.
     1 46    b.  Matching university resources with the needs of
     1 47 existing Iowa firms.
     1 48    c.  Evaluation of university research for
     1 49 commercial potential.
     1 50    d.  The development of a plan that will improve
     2  1 private sector access to the university and the
     2  2 transfer of technology from the university to the
     2  3 private sector.
     2  4    2.  In order to carry out its objectives, the
     2  5 consortium shall perform, but is not limited to, the
     2  6 following tasks:
     2  7    a.  Receive and review selected research synopses.
     2  8    b.  Disseminate information on research activities
     2  9 of the university.
     2 10    c.  Identify research needs of existing Iowa
     2 11 businesses and recommend ways in which the university
     2 12 can meet these needs.
     2 13    d.  On a case=by=case basis, suggest business and
     2 14 financial tactics useful in realizing the commercial
     2 15 potential of university research projects.
     2 16    e.  Provide applied technical referral services, if
     2 17 appropriate, including but not limited to the
     2 18 following duties:
     2 19    (1)  To determine and evaluate the research or
     2 20 applied technology needs of businesses and farms
     2 21 requesting assistance.
     2 22    (2)  To recommend technology transfer strategies to
     2 23 farms for more efficient production of agricultural
     2 24 commodities, or to businesses for developing and
     2 25 testing new products, adapting new technologies to
     2 26 manufacturing processes or methods, conducting
     2 27 marketing analyses of new products or processes, and
     2 28 identifying potential financing on new technology=
     2 29 based products or manufacturing processes.
     2 30    (3)  To refer businesses and farmers to
     2 31 universities, community colleges, small business
     2 32 development centers, other private businesses, and
     2 33 other research and technology transfer activities and
     2 34 programs which are beneficial to the development of
     2 35 new products and the application of technology.
     2 36    Sec. ___.  Section 262B.5, Code Supplement 2003, is
     2 37 amended by striking the section and inserting in lieu
     2 38 thereof the following:
     2 39    262B.5  REGENTS AND DEPARTMENT OF ECONOMIC
     2 40 DEVELOPMENT.
     2 41    The state board of regents and the Iowa department
     2 42 of economic development shall enter into an agreement
     2 43 under chapter 28E to coordinate and facilitate the
     2 44 activities of the consortiums.  The state board of
     2 45 regents and the Iowa department of economic
     2 46 development shall report annually to the governor and
     2 47 the general assembly concerning the activities of the
     2 48 consortiums.>
     2 49 #2.  Page 25, by inserting after line 31, the
     2 50 following:
     3  1    <Sec. ___.  Section 455B.423, subsection 1, Code
     3  2 2003, is amended to read as follows:
     3  3    1.  A hazardous substance remedial fund is created
     3  4 within the state treasury.  Moneys received from fees,
     3  5 penalties, general revenue, federal funds, gifts,
     3  6 bequests, donations, or other moneys so designated
     3  7 shall be deposited in the state treasury to the credit
     3  8 of the fund.  Any unexpended balance in the remedial
     3  9 fund at the end of each fiscal year shall be retained
     3 10 in the fund.  However, any unexpended balance shall be
     3 11 transferred to the general fund to replace funds
     3 12 appropriated from the general fund during fiscal year
     3 13 1985 and fiscal year 1986 for the purposes for which
     3 14 expenditures from the remedial fund are allowed.>
     3 15 #3.  Page 31, by inserting after line 7, the
     3 16 following:
     3 17    <Sec. ___.  Section 533C.103, subsection 4, Code
     3 18 Supplement 2003, is amended to read as follows:
     3 19    4.  A The following entities whether chartered or
     3 20 organized under the laws of a state or of the United
     3 21 States:  a bank, bank holding company, savings and
     3 22 loan association, savings bank, credit union, office
     3 23 of an international banking corporation, branch of a
     3 24 foreign bank, corporation organized pursuant to the
     3 25 federal Bank Service Company Act, 12 U.S.C. }
     3 26 1861==1867, or corporation organized under the federal
     3 27 Edge Act, 12 U.S.C. } 611==633, under the laws of a
     3 28 state or the United States.>
