1 9 File 395, is amended by adding the following new
1 10 subparagraph:
1 11 NEW SUBPARAGRAPH. (6) Moneys placed in a
1 12 depository for the purpose of completing an electronic
1 13 financial transaction pursuant to section 8A.222 or
1 14 331.427.>
1 15 #2. Page 19, by inserting after line 8 the
1 16 following:
1 17 <Sec. . Section 99G.10, subsection 2, if
1 18 enacted by 2003 Iowa Acts, Senate File 453, section
1 19 72, is amended to read as follows:
1 20 2. Subject to the approval of the board, the chief
1 21 executive officer shall have the sole power to
1 22 designate particular employees as key personnel, but
1 23 may take advice from the department of personnel in
1 24 making any such designations. All key personnel shall
1 25 be exempt from the merit system described in chapter
1 26 19A 8A, article 4. The chief executive officer and
1 27 the board shall have the sole power to employ,
1 28 classify, and fix the compensation of key personnel.
1 29 All other employees shall be employed, classified, and
1 30 compensated in accordance with chapters 19A chapter
1 31 8A, article 4, and chapter 20.
1 32 Sec. . Section 99G.22, subsection 1, if enacted
1 33 by 2003 Iowa Acts, Senate File 453, is amended to read
1 34 as follows:
1 35 1. The authority shall investigate the financial
1 36 responsibility, security, and integrity of any lottery
1 37 system vendor who is a finalist in submitting a bid,
1 38 proposal, or offer as part of a major procurement
1 39 contract. Before a major procurement contract is
1 40 awarded, the division of criminal investigation of the
1 41 department of public safety shall conduct a background
1 42 investigation of the vendor to whom the contract is to
1 43 be awarded. The chief executive officer and board
1 44 shall consult with the division of criminal
1 45 investigation and shall provide for the scope of the
1 46 background investigation and due diligence to be
1 47 conducted in connection with major procurement
1 48 contracts. At the time of submitting a bid, proposal,
1 49 or offer to the authority on a major procurement
1 50 contract, the authority shall require that each vendor
2 1 submit to the division of criminal investigation
2 2 appropriate investigation authorization to facilitate
2 3 this investigation, together with an advance of funds
2 4 to meet the anticipated investigation costs. If the
2 5 division of criminal investigation determines that
2 6 additional funds are required to complete an
2 7 investigation, the vendor will be so advised. The
2 8 background investigation by the division of criminal
2 9 investigation may include a national criminal history
2 10 record check through the federal bureau of
2 11 investigation. The screening of vendors or their
2 12 employees through the federal bureau of investigation
2 13 shall be conducted by submission of fingerprints
2 14 through the state criminal history record repository
2 15 to the federal bureau of investigation.
2 16 Sec. . Section 99G.37, subsection 2, if enacted
2 17 by 2003 Iowa Acts, Senate File 453, section 90, is
2 18 amended to read as follows:
2 19 2. In any bidding process, the authority may
2 20 administer its own bidding and procurement or may
2 21 utilize the services of the department of general
2 22 administrative services, or its successor, or other
2 23 state agency.
2 24 Sec. . Section 99G.38, subsection 3, if enacted
2 25 by 2003 Iowa Acts, Senate File 453, section 91, is
2 26 amended to read as follows:
2 27 3. The state of Iowa offset program, as provided
2 28 in section 421.17 8A.504, shall be available to the
2 29 authority to facilitate receipt of funds owed to the
2 30 authority.>

2 32 following:
2 33 <Sec. . Section 231.56A, if enacted by 2003
2 34 Iowa Acts, Senate File 4165, section 1, is amended to
2 35 read as follows:
2 36 231.56A ELDER ABUSE INITIATIVE, EMERGENCY SHELTER,
2 37 AND SUPPORT SERVICES PROJECTS.
2 38 1. Through the state's service contract process
2 39 adopted pursuant to section 8.47, the department shall
2 40 identify area agencies on aging that have demonstrated
2 41 the ability to provide a collaborative response to the
2 42 immediate needs of elders in the area agency on aging
2 43 service area for the purpose of implementing elder
2 44 abuse initiative, emergency shelter, and support
2 45 services projects. The projects shall be implemented
2 46 only in the counties within an area agency on aging
2 47 service area that have a multidisciplinary team
2 48 established pursuant to section 235B.1.
2 49 2. The target population of the projects shall be
2 50 any elder residing in the service area of an area
3 1 agency on aging who meets both of the following
3 2 conditions:
3 3 a. Is the subject of a report of suspected
3 4 dependent adult abuse pursuant to chapter 235B.
3 5 b. Is not receiving assistance under a county
3 6 management plan approved pursuant to section 331.439.
3 7 3. The area agencies on aging implementing the
3 8 projects shall identify allowable emergency shelter
3 9 and support services, state funding, outcomes,
3 10 reporting requirements, and approved community
3 11 resources from which services may be obtained under
3 12 the projects. The area agency on aging shall identify
3 13 at least one provider of case management services for
3 14 the project area.
3 15 4. The area agencies on aging shall implement the
3 16 projects and shall coordinate the provider network
3 17 through the use of referrals or other engagement of
3 18 community resources to provide services to elders.
3 19 5. The department shall award funds to the area
3 20 agencies on aging in accordance with the state's
3 21 service contract process. Receipt and expenditures of
3 22 moneys under the projects are subject to examination,
3 23 including audit, by the department.
3 24 6. This section shall not be construed and is not
3 25 intended as, and shall not imply, a grant of
3 26 entitlement for services to individuals who are not
3 27 otherwise eligible for the services or for utilization
3 28 of services that do not currently exist or are not
3 29 otherwise available.>
3 30 #4. Page 20, by inserting after line 26 the
3 31 following:
3 32 <Sec. . Section 321.69, subsection 9, as
3 33 amended by 2003 Acts, House File 502, section 3, is
3 34 amended to read as follows:
3 35 9. This Except for subsection 9A, this section
3 36 does not apply to motor trucks and truck tractors with
3 37 a gross vehicle weight rating of sixteen thousand
3 38 pounds or more, vehicles more than nine model years
3 39 old, motorcycles, motorized bicycles, and special
3 40 mobile equipment. This section does apply to motor
3 41 homes. The requirement in subsection 1 that the new
3 42 certificate of title and registration receipt shall
3 43 state on the face of the title the total cumulative
3 44 dollar amount of damage does not apply to a vehicle
3 45 with a certificate of title bearing a designation that
3 46 the vehicle was previously titled on a salvage
3 47 certificate of title pursuant to section 321.52,
3 48 subsection 4, paragraph "b", or to a vehicle with a
3 49 certificate of title bearing a "REBUILT" or "SALVAGE"
3 50 designation pursuant to section 321.24, subsection 4
4 1 or 5. This Except for subsection 9A, this section
4 2 does not apply to new motor vehicles with a true
4 3 mileage, as defined in section 321.71, of one thousand
4 4 miles or less, unless such vehicle has incurred damage
4 5 as defined in subsection 2.>

4 9 section 44, subsection 8, if enacted, is amended to
4 10 read as follows:
4 11 8. STATUTORY REQUIREMENTS. The requirements of
4 12 sections 18.6 8A.311 and 72.3 and the administrative
4 13 rules implementing section 8.47 are not applicable to
4 14 the services procurement process used to implement the
4 15 outcomes=based service system redesign in accordance
4 16 with this section. The department of human services
4 17 may enter into competitive negotiations and proposal
4 18 modifications with each successful contractor as
4 19 necessary to implement the provisions of this
4 20 section.>
