NEW SECTION. 321J.2C PERSONS FOUND 1 6 NOT GUILTY. 1 7 1. Notwithstanding any other provision of this 1 8 chapter to the contrary, if any prosecution for a 1 9 violation of section 321J.2 or 321J.2A does not result 1 10 in a conviction, and the defendant's driver's license 1 11 or nonresident operating privilege has been revoked 1 12 under section 321J.12 for the occurrence from which 1 13 the arrest arose, the department shall, upon receipt 1 14 of the court order finding the defendant not guilty, 1 15 immediately rescind the revocation order and reinstate 1 16 the defendant's license. 1 17 2. Notwithstanding section 321.12 or any other 1 18 provision of chapter 321 or 321J to the contrary, the 1 19 director shall immediately destroy any operating 1 20 records pertaining to a revocation under section 1 21 321J.12 for the occurrence from which an arrest arose 1 22 when the defendant was subsequently prosecuted and 1 23 found not guilty upon receipt of the court order 1 24 finding the defendant not guilty.> 1 25 #2.
