H.F. _____ Section 1. Section 635.2, subsection 2, Code 2017, is 1 amended to read as follows: 2 2. The name and address of the surviving spouse , and the 3 name and relationship of each beneficiary in a testate estate 4 or known heirs in an intestate estate . 5 Sec. 2. Section 635.2, Code 2017, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 2A. The name and relationship of each heir 8 so far as known to the petitioner in an intestate estate. 9 Sec. 3. APPLICABILITY. This Act applies to petitions filed 10 on or after the effective date of this Act. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to the information required to be 15 contained in petitions for administration of small estates. 16 Code chapter 635 provides for a simplified probate procedure 17 for small estates, which are estates where the gross value of 18 the decedent’s probate assets does not exceed $100,000. A 19 petition for administration of a small estate must contain 20 certain specified information, including the name and 21 relationship of each beneficiary in a testate estate. The bill 22 provides that the name and relationship of each beneficiary 23 in a testate estate does not need to be contained in such a 24 petition. 25 The bill applies to petitions filed on or after the effective 26 date of this bill. 27 -1- LSB 1823YC (2) 87 jh/rj 1/ 1
