2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. NEW SECTION. 147.115 Hysterectomy — consent.
21. A woman who is eighteen years of age or older or who has
3attained majority as provided in section 599.1 shall have legal
4capacity to provide informed consent to a hysterectomy.
52. A person licensed or certified to practice a profession
6shall not condition the provision of medical care or services
7to a woman for a hysterectomy on the obtaining of consent to
8the hysterectomy from any other person including the woman’s
9spouse.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
13This bill relates to consent to a hysterectomy. The bill
14provides that a woman who is 18 years of age or older or who
15has attained majority by marriage shall have legal capacity to
16provide informed consent to a hysterectomy. Additionally, a
17health care professional shall not condition the provision of
18medical care or services to a woman for a hysterectomy on the
19obtaining of consent to the hysterectomy from any other person
20including the woman’s spouse.
