  1  1    Section 1.  Section 257.8, subsection 1, Code Supplement
  1  2 2003, is amended to read as follows:
  1  3    1.  STATE PERCENT OF GROWTH.  The state percent of growth
  1  4 for the budget year beginning July 1, 2003, is two percent.
  1  5 The state percent of growth for the budget year beginning July
  1  6 1, 2004, is two percent.  The state percent of growth for the
  1  7 budget year beginning July 1, 2005, is three percent.  The
  1  8 state percent of growth for each subsequent budget year shall
  1  9 be established by statute which shall be enacted within thirty
  1 10 days of the submission in the year preceding the base year of
  1 11 the governor's budget under section 8.21.  The establishment
  1 12 of the state percent of growth for a budget year shall be the
  1 13 only subject matter of the bill which enacts the state percent
  1 14 of growth for a budget year.
  1 15    Notwithstanding the figure established for the state
  1 16 percent of growth for the budget year beginning July 1, 2005,
  1 17 in unnumbered paragraph 1 of this subsection, if the revenue
  1 18 estimating conference as provided for in Code section 8.22A,
  1 19 agrees to a revenue estimate of general fund receipts at its
  1 20 December 2004 meeting for the fiscal year beginning July 1,
  1 21 2005, of at least four percent over the actual general fund
  1 22 receipts for the fiscal year ending June 30, 2004, the state
  1 23 percent of growth for the budget year beginning July 1, 2005,
  1 24 is four percent.
  1 25    Sec. 2.  Notwithstanding the thirty-day deadline for the
  1 26 enactment of the state percent of growth provided in section
  1 27 257.8, subsection 1, such deadline shall not apply to the Act
  1 28 enacted which establishes the state percent of growth during
  1 29 the 2004 Regular Session of the Eightieth General Assembly.
  1 30    Sec. 3.  APPLICABILITY.  This Act is applicable for
  1 31 computing state aid under the state school foundation program
  1 32 for the school budget year beginning July 1, 2005.  
  1 33                           EXPLANATION
  1 34    This bill establishes a state percent of growth of 3
  1 35 percent for purposes of the state school foundation program
  2  1 for the school budget year beginning July 1, 2005.  The bill
  2  2 provides that, notwithstanding the 3 percent figure, in the
  2  3 event that the revenue estimating conference as provided for
  2  4 in Code section 8.22A agrees to a general fund revenue
  2  5 estimate at its December 2004 meeting for the fiscal year
  2  6 beginning July 1, 2005, of at least 4 percent over the actual
  2  7 general fund receipts for the fiscal year ending June 30,
  2  8 2004, the state percent of growth for the budget year
  2  9 beginning July 1, 2005, shall be 4 percent.
  2 10    The bill provides that the provisions of Code section
  2 11 257.8, subsection 1, establishing a 30-day deadline for the
  2 12 enactment of the state percent of growth shall not apply to
  2 13 the Act enacted which establishes the state percent of growth
  2 14 during the 2004 Regular Session of the Eightieth General
  2 15 Assembly.
  2 16    The bill is applicable for state aid computation under the
  2 17 school foundation program for the school budget year beginning
  2 18 July 1, 2005.
