  1  1    Section 1.  Section 203.1, subsection 10, unnumbered
  1  2 paragraph 1, Code Supplement 2003, is amended to read as
  1  3 follows:
  1  4    "Grain dealer" means a person who buys cumulatively
  1  5 purchases at least one thousand bushels of grain from
  1  6 producers during any calendar month one thousand bushels of
  1  7 grain or more directly from the producers of the grain, if
  1  8 such grain is delivered within or into this state for purposes
  1  9 of resale, milling, or processing in this state.  However,
  1 10 "grain dealer" does not include any of the following:  
  1 11                           EXPLANATION
  1 12    This bill amends provisions in Code chapter 203 regulating
  1 13 grain dealers by the department of agriculture and land
  1 14 stewardship.  Grain dealers must be licensed by the department
  1 15 and adhere a number of financial requirements (Code section
  1 16 203.5).  Grain dealers are also required to participate in the
  1 17 grain depositors and sellers indemnity fund (Code section
  1 18 203.4).  The bill amends the definition of "grain dealer" to
  1 19 make it more restrictive.  Code section 203.1 currently
  1 20 provides that a grain dealer is a person who purchases at
  1 21 least 1,000 bushels of grain from Iowa farmers ("producers")
  1 22 during any calendar month for purposes of resale, milling, or
  1 23 processing.  The bill qualifies the purchases of grain.
  1 24 Before a person purchasing the 1,000 bushels of grain from
  1 25 producers is considered a grain dealer, the grain must be
  1 26 delivered within or into the state.
