  1  1    Section 1.  Section 7J.1, subsection 2, paragraphs c and d,
  1  2 Code Supplement 2003, are amended to read as follows:
  1  3    c.  Notwithstanding any provision of law to the contrary,
  1  4 the governor may set the salary of a director of a charter
  1  5 agency under the pay plan for exempt positions in the
  1  6 executive branch of government.  In addition, beginning July
  1  7 1, 2007, the governor may authorize the payment of a bonus to
  1  8 a director of a charter agency in an amount not in excess of
  1  9 fifty percent of the director's annual rate of pay, based upon
  1 10 the governor's evaluation of the director's performance in
  1 11 relation to the goals set forth in the annual performance
  1 12 agreement.
  1 13    d.  A Beginning July 1, 2007, a director of a charter
  1 14 agency may authorize the payment of bonuses to employees of
  1 15 the charter agency in a total amount not in excess of fifty
  1 16 percent of the director's annual rate of pay, based upon the
  1 17 director's evaluation of the employees' performance.
  1 18    Sec. 2.  2001 Iowa Acts, chapter 190, section 3, unnumbered
  1 19 paragraph 3, is amended to read as follows:
  1 20    A person whose salary is established pursuant to section 4
  1 21 of this Act and who is a full-time, year-round employee of the
  1 22 state shall not receive any other remuneration from the state
  1 23 or from any other source for the performance of that person's
  1 24 duties unless the additional remuneration is first approved by
  1 25 the governor or authorized by law.  However, this provision
  1 26 does not exclude the reimbursement for necessary travel and
  1 27 expenses incurred in the performance of duties or fringe
  1 28 benefits normally provided to employees of the state.
  1 29    Sec. 3.  STATE EMPLOYEE BONUSES – MORATORIUM.  Unless
  1 30 otherwise required pursuant to a collective bargaining
  1 31 agreement, a state employee shall not receive any additional
  1 32 remuneration in the form of a bonus or during for the time
  1 33 period beginning on or after the effective date of this Act
  1 34 and ending June 30, 2007.
  1 35    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2  1 immediate importance, takes effect upon enactment.  
  2  2                           EXPLANATION
  2  3    This bill prohibits the granting of bonuses to state
  2  4 employees until no earlier than July 1, 2007.
  2  5    Code section 7J.1, concerning charter agencies, is amended
  2  6 to prohibit the payment of bonuses to a director of a charter
  2  7 agency or to employees of a charter agency until July 1, 2007.
  2  8    2001 Iowa Acts, chapter 190, concerning the pay of
  2  9 appointed state officers, is amended to eliminate the ability
  2 10 of the officer to receive additional remuneration if approved
  2 11 by the governor or otherwise authorized by law.
  2 12    The bill also establishes a moratorium on the granting of
  2 13 bonuses to state employees beginning with the effective date
  2 14 of this bill and ending June 30, 2007, unless a collective
  2 15 bargaining agreement otherwise provides.
  2 16    The bill takes effect upon enactment.
