  1  1    Section 1.  Section 15F.103, subsections 2 and 3, Code
  1  2 2003, are amended to read as follows:
  1  3    2.  Establish the vision Iowa program and the community
  1  4 attraction and tourism program.
  1  5    3.  Oversee and provide approval of the administration of
  1  6 the vision Iowa program and the community attraction and
  1  7 tourism program by the department.
  1  8    Sec. 2.  Section 15F.104, Code 2003, is amended to read as
  1  9 follows:
  1 10    15F.104  DEPARTMENT DUTIES.
  1 11    The department, subject to approval by the board, shall
  1 12 adopt administrative rules pursuant to chapter 17A necessary
  1 13 to administer the community attraction and tourism program and
  1 14 the vision Iowa program.  The department shall provide the
  1 15 board with assistance in implementing administrative
  1 16 functions, marketing the programs program, providing technical
  1 17 assistance and application assistance to applicants under the
  1 18 programs program, negotiating contracts, and providing project
  1 19 follow-up.  The department, in cooperation with the treasurer
  1 20 of state, may conduct negotiations on behalf of the board with
  1 21 applicants regarding terms and conditions applicable to awards
  1 22 under the programs program.
  1 23    Sec. 3.  Section 15F.106, Code 2003, is amended to read as
  1 24 follows:
  1 25    15F.106  BENEFITS.
  1 26    Any applicant awarded financial assistance by the board
  1 27 under both the vision Iowa program established in section
  1 28 15F.302 and the community attraction and tourism program
  1 29 established in section 15F.202 shall provide and pay at least
  1 30 fifty percent of the cost of a standard medical insurance plan
  1 31 for all full-time employees working at the project after the
  1 32 completion of the project for which financial assistance was
  1 33 received.
  1 34    Sec. 4.  Section 15F.202, subsection 1, Code Supplement
  1 35 2003, is amended to read as follows:
  2  1    1.  The board department shall establish and the
  2  2 department, subject to direction and approval by the board,
  2  3 shall administer a community attraction and tourism program to
  2  4 assist communities in the development, creation, and regional
  2  5 marketing of multiple-purpose attraction or tourism
  2  6 facilities.
  2  7    Sec. 5.  Section 15F.202, subsection 2, unnumbered
  2  8 paragraph 1, Code Supplement 2003, is amended to read as
  2  9 follows:
  2 10    A city or county in the state or public organization may
  2 11 submit an application to the board department for financial
  2 12 assistance for a project under the program.  The assistance
  2 13 shall be provided only from funds, rights, and assets legally
  2 14 available to the board department and shall be in the form of
  2 15 grants, loans, forgivable loans, and credit enhancement and
  2 16 financing instruments.  The application shall include, but not
  2 17 be limited to, the following information:
  2 18    Sec. 6.  Section 15F.202, subsection 3, Code Supplement
  2 19 2003, is amended to read as follows:
  2 20    3.  A school district, in cooperation with a city or
  2 21 county, may submit a joint application for financial
  2 22 assistance for a project under the program.  The assistance
  2 23 shall be provided only from funds, rights, and assets legally
  2 24 available to the board department and shall be in the form of
  2 25 grants, loans, forgivable loans, and credit enhancement and
  2 26 financing instruments.  In addition to the information
  2 27 required in subsection 2, the application shall include a
  2 28 demonstration that the intended future use of the project
  2 29 shall be by both joint applicants.
  2 30    Sec. 7.  Section 15F.203, subsections 1 and 2, Code 2003,
  2 31 are amended to read as follows:
  2 32    1.  Applications for assistance under the program shall be
  2 33 submitted to and reviewed by the department.  For those
  2 34 applications that meet the eligibility criteria, the
  2 35 department shall provide a staff review analysis and
  3  1 evaluation to the community attraction and tourism program
  3  2 review committee referred to in subsection 2 and the board.
  3  3    2.  A review committee composed of five members of the
  3  4 board shall review community attraction and tourism program
  3  5 applications submitted to the board and make recommendations
  3  6 regarding the applications to the board.  The review committee
  3  7 shall consist of members of the board listed in section
  3  8 15F.102, subsection 2, paragraphs "a" through "c".
  3  9    Sec. 8.  Section 15F.203, subsection 3, unnumbered
  3 10 paragraph 1, Code 2003, is amended to read as follows:
  3 11    When reviewing the applications, the review committee and
  3 12 the department shall consider, at a minimum, all of the
  3 13 following:
  3 14    Sec. 9.  Section 15F.203, subsections 4 and 5, Code 2003,
  3 15 are amended to read as follows:
  3 16    4.  Upon review of the recommendations of the review
  3 17 committee applications, the board department shall approve,
  3 18 defer, or deny the applications.
  3 19    5.  Upon approval of an application for financial
  3 20 assistance under the program, the board department shall
  3 21 notify the treasurer of state regarding the amount of moneys
  3 22 needed to satisfy the award of financial assistance and the
  3 23 terms of the award.  The treasurer of state shall notify the
  3 24 department anytime moneys are disbursed to a recipient of
  3 25 financial assistance under the program.
  3 26    Sec. 10.  Section 15F.204, subsections 1 and 3, Code 2003,
  3 27 are amended to read as follows:
  3 28    1.  A community attraction and tourism fund is created as a
  3 29 separate fund in the state treasury under the control of the
  3 30 board department, consisting of any moneys appropriated by the
  3 31 general assembly and any other moneys available to and
  3 32 obtained or accepted by the board department for placement in
  3 33 the fund.
  3 34    3.  The fund shall be used to provide assistance only from
  3 35 funds, rights, and assets legally available to the board
  4  1 department in the form of grants, loans, forgivable loans, and
  4  2 credit enhancements and financing instruments under the
  4  3 community attraction and tourism program established in
  4  4 section 15F.202.  An applicant under the community attraction
  4  5 and tourism program shall not receive financial assistance
  4  6 from the fund in an amount exceeding fifty percent of the
  4  7 total cost of the project.
  4  8    Sec. 11.  Section 15F.204, subsection 5, unnumbered
  4  9 paragraph 1, Code 2003, is amended to read as follows:
  4 10    At the beginning of each fiscal year, the board department
  4 11 shall allocate all moneys in the fund in the following manner:
  4 12    Sec. 12.  Section 15F.204, subsection 7, Code 2003, is
  4 13 amended to read as follows:
  4 14    7.  If any portion of the allocated moneys under subsection
  4 15 5, paragraph "a", has not been awarded by April 1 of the
  4 16 fiscal year for which the allocation is made, the portion
  4 17 which has not been awarded may be utilized by the board
  4 18 department to provide financial assistance under the program
  4 19 to any city or county in the state.
  4 20    Sec. 13.  NEW SECTION.  15F.205  RULES.
  4 21    The department shall adopt administrative rules pursuant to
  4 22 chapter 17A necessary to administer the community attraction
  4 23 and tourism program.  
  4 24                           EXPLANATION
  4 25    This bill relates to the administration of the community
  4 26 attraction and tourism program.
  4 27    Currently, the vision Iowa board directs and approves the
  4 28 administration of the community attraction and tourism program
  4 29 by the department of economic development.  The bill
  4 30 eliminates the direction and approval of the vision Iowa board
  4 31 and allows the department to solely administer the program.
  4 32    The bill eliminates the requirement that the vision Iowa
  4 33 board approve the administrative rules adopted by the
  4 34 department to administer the program.  The bill provides that
  4 35 applications for financial assistance under the program shall
  5  1 be submitted to the department.  The bill eliminates an
  5  2 application review committee composed of members of the vision
  5  3 Iowa board and provides that the department shall review the
  5  4 applications and either approve, defer, or deny the
  5  5 applications.  The bill makes other conforming amendments that
  5  6 relate to the department being the sole administrator of the
  5  7 program.
