1 1 Section 1. NEW SECTION. 99B.10C CHAMBER OF COMMERCE –
1 2 ELECTRICAL AND MECHANICAL AMUSEMENT DEVICES – REGISTRATION.
1 3 1. A chamber of commerce which is organized as a not-for-
1 4 profit entity may operate electrical and mechanical amusement
1 5 devices where the outcome is not primarily determined by the
1 6 skill or knowledge of the operator pursuant to the
1 7 requirements of this section upon registering with the
1 8 department. Each chamber of commerce that registers with the
1 9 department under this section shall pay an annual registration
1 10 fee of two thousand five hundred dollars. Registration shall
1 11 be submitted on forms designated by the department that shall
1 12 contain the information required by the department by rule.
1 13 2. A chamber of commerce registered under this section
1 14 shall comply with the requirements of section 99B.10 for
1 15 operating an electrical and mechanical amusement device except
1 16 that the provisions of section 99B.10, subsection 4, limiting
1 17 the number of devices allowed, and the provisions of section
1 18 99B.10, subsection 5, shall not apply.
1 19 EXPLANATION
1 20 This bill concerns the operation of electrical and
1 21 mechanical amusement devices by a chamber of commerce. Under
1 22 current law, electrical and mechanical amusement devices where
1 23 the outcome is not primarily determined by skill are limited
1 24 to no more than four devices for a nonprofit organization, and
1 25 no more than two devices for any other person, and the prizes
1 26 awarded by these devices must be redeemed on the premises
1 27 where the devices are located. The bill provides an exception
1 28 to these requirements for a chamber of commerce that registers
1 29 with the department of inspections and appeals upon paying an
1 30 annual registration fee of $2,500.
