1 1 Section 1. NEW SECTION. 38E.1 SECURE AND VERIFIABLE
1 2 IDENTIFICATION.
1 3 1. A public benefit or service of this state, including a
1 4 law enforcement service, which requires the recipient of the
1 5 public benefit or service to produce identification, shall not
1 6 be provided by a department, agency, or any political
1 7 subdivision of this state, or other entity within the
1 8 executive, legislative, or judicial branch of this state,
1 9 unless the identification is issued by a federal or state
1 10 authority and is subject to verification by a federal law
1 11 enforcement, intelligence, or homeland security agency.
1 12 2. An elected or appointed official, employee, or other
1 13 contractor or agent of this state or of a political
1 14 subdivision of this state who takes any action inconsistent
1 15 with subsection 1 shall be deemed to be acting beyond the
1 16 scope of authority granted by law and shall not be immune from
1 17 liability for such action unless such immunity is conferred by
1 18 the Constitution of the United States or the Constitution of
1 19 the State of Iowa and cannot be waived.
1 20 EXPLANATION
1 21 This bill relates to the receipt of public benefits or
1 22 services and certain identification requirements.
1 23 The bill prohibits a public benefit or service of the
1 24 state, including a law enforcement service, which requires the
1 25 recipient of the public benefit or service to produce
1 26 identification, from being provided by a department, agency,
1 27 or any political subdivision of the state, or other entity
1 28 within the executive, legislative, or judicial branch of the
1 29 state, unless the identification is issued by a federal or
1 30 state authority and is subject to verification by a federal
1 31 law enforcement, intelligence, or homeland security agency.
1 32 The bill also provides that an elected or appointed
1 33 official, employee, or other contractor or agent of the state
1 34 who violates the bill is not immune from liability for such
1 35 action, unless such immunity is conferred by the United States
2 1 or Iowa Constitution and cannot be waived.
