PAG LIN 1 1 Section 1. Section 237A.3A, Code 2003, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 6A. Rules of the department shall 1 4 prohibit the licensing, as foster family homes, of individuals 1 5 who are homosexual. For the purpose of this subsection, 1 6 "homosexual" means a person whose sexual orientation is 1 7 characterized by a tendency to direct sexual desire toward 1 8 another of the same sex. 1 9 Sec. 2. Section 600.4, Code 2003, is amended to read as 1 10 follows: 1 11 600.4 QUALIFICATIONS TO FILE ADOPTION PETITION. 1 12 1. Any person who may adopt may file an adoption petition 1 13 under section 600.3. 1 14 2. The following persons may adopt: 1 151.a. An unmarried adult. 1 162.b. Husband and wife together. 1 173.c. A husband or wife separately if the person to be 1 18 adopted is not the other spouse and if the adopting spouse: 1 19a.(1) Is the stepparent of the person to be adopted; 1 20b.(2) Has been separated from the other spouse by reason 1 21 of the other spouse's abandonment as prescribed in section 1 22 597.10; or 1 23c.(3) Is unable to petition with the other spouse because 1 24 of the prolonged and unexplained absence, unavailability, or 1 25 incapacity of the other spouse, or because of an unreasonable 1 26 withholding of joinder by the other spouse, as determined by 1 27 the juvenile court or court under section 600.5, subsection 7. 1 28 3. A person who is otherwise eligible to adopt under this 1 29 section is prohibited from adopting if the person is a 1 30 homosexual. For the purposes of this subsection, "homosexual" 1 31 means a person whose sexual orientation is characterized by a 1 32 tendency to direct sexual desire toward another of the same 1 33 sex. 1 34 EXPLANATION 1 35 This bill prohibits the licensing of individuals who are 2 1 homosexual as foster family homes. The bill also prohibits a 2 2 person who is otherwise eligible to adopt under the current 2 3 adoption provisions from adopting if the person is a 2 4 homosexual. 2 5 LSB 2018XC 80 2 6 pf/sh/8.1
