1 3 A Resolution requesting the commissioner of insurance
1 4 to submit an annual report to the legislative council
1 5 containing administrative and financial information
1 6 relating to medical malpractice claims.
1 7 WHEREAS, rising health care costs and the
1 8 affordability of medical malpractice insurance has led
1 9 to the need for an examination of the factors
1 10 impacting the medical malpractice insurance market in
1 11 this state; and
1 12 WHEREAS, the commissioner of insurance is the chief
1 13 executive officer of the insurance division within the
1 14 department of commerce charged with regulating,
1 15 supervising, and directing the conduct of the business
1 16 of insurance in this state; NOW THEREFORE,
1 17 BE IT RESOLVED BY THE SENATE, That the commissioner
1 18 of insurance is requested to collect information from
1 19 every insurer providing medical malpractice insurance
1 20 coverage in this state, relating to, but not limited
1 21 to, rate filings including ratemaking methodology,
1 22 loss trends and ratios including loss development and
1 23 loss adjustment expenses, investment earnings and
1 24 losses, the frequency of claims, the availability of
1 25 carriers in the medical malpractice insurance
1 26 marketplace, and any other relevant information
1 27 affecting the availability and affordability of
1 28 medical malpractice insurance as deemed appropriate by
1 29 the commissioner; and
1 30 BE IT FURTHER RESOLVED, That the commissioner of
2 1 insurance is requested to prepare an annual report of
2 2 the foregoing information and to submit such report to
2 3 the legislative council by December 30 of each year,
2 4 beginning in 2004.
