  1  1    Section 1.  Section 279.10, subsection 3, Code 2003, is
  1  2 amended to read as follows:
  1  3    3.  a.  The board of directors of a school district may
  1  4 request approval from the department of education for a pilot
  1  5 program for an innovative school year.  The number of days per
  1  6 year that school is in session may be more or less than those
  1  7 specified in subsection 1, but the innovative school year
  1  8 shall provide for an equivalent number of total hours that
  1  9 school is in session.
  1 10    b.  The board shall file a request for approval with the
  1 11 department not later than November 1 of the preceding school
  1 12 year.  The request shall detail the educational, financial,
  1 13 social, or other benefits the school district expects to
  1 14 achieve through the pilot program.  The request shall include
  1 15 a listing of the savings and goals to be attained under the
  1 16 innovative school year subject to rules adopted by the
  1 17 department under chapter 17A.  The department shall notify the
  1 18 districts of the approval or denial of pilot programs not
  1 19 later than the next following January 15.
  1 20    c.  A request to continue an innovative school year pilot
  1 21 project after its initial year also shall include an
  1 22 evaluation of the savings and impacts on the educational
  1 23 program in the district.
  1 24    d.  Participation in a pilot project shall not modify
  1 25 provisions of a master contract negotiated between a school
  1 26 district and a certified bargaining unit pursuant to chapter
  1 27 20 unless mutually agreed upon.
  1 28    e.  The department shall approve not more than ten
  1 29 innovative school year pilot program requests per school year.
  1 30 This paragraph is repealed effective June 30, 2007.
  1 31    Sec. 2.  INSTRUCTIONAL TIME.  Annually, for a period of
  1 32 three years, the department of education shall conduct a
  1 33 survey of school districts to compile data regarding the
  1 34 amount of total scheduled instructional hours per day provided
  1 35 at the elementary, junior high or middle school, and high
  2  1 school levels pursuant to section 256.7, subsection 19, and
  2  2 section 279.10, subsection 1.  The department shall submit a
  2  3 report containing the summarized data, along with its findings
  2  4 and recommendations to the general assembly by January 15.
  2  5 Reports submitted in 2006 and 2007 shall compare results of
  2  6 school districts implementing, during the previous school
  2  7 year, financially based innovative school years with school
  2  8 districts not under financially based innovative school years.
