  1  4 RELATING TO THE CONTENT OF IMMUNIZATIONS, AND MAKING A PENALTY
  1  5    APPLICABLE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  NEW SECTION.  135.39A  EARLY CHILDHOOD
  1 10 IMMUNIZATIONS – CONTENT.
  1 11    1.  Beginning January 1, 2006, early childhood
  1 12 immunizations administered in this state shall not contain
  1 13 more than trace amounts of mercury.
  1 14    2.  For the purposes of this section:
  1 15    a.  "Early childhood immunizations" means immunizations
  1 16 administrated to children under eight years of age, unless
  1 17 otherwise provided in this section.
  1 18    b.  "Trace amounts" means trace amounts as defined by the
  1 19 United States food and drug administration.
  1 20    3.  The prohibition under this section shall not apply to
  1 21 early childhood immunizations for influenza or in times of
  1 22 emergency or epidemic as determined by the director of public
  1 23 health.  If an emergency or epidemic is determined to exist by
  1 24 the director of public health under this subsection, the
  1 25 director of public health shall notify the state board of
  1 26 health, the governor, and the legislative council, and shall
  1 27 notify the public upon request.
  1 28    Sec. 2.  NEW SECTION.  514C.21  COVERAGE FOR IMMUNIZATIONS
  1 29 – MERCURY.
  1 30    1.  Third-party payment provider contracts or policies
  1 31 delivered, issued for delivery, continued, or renewed in this
  1 32 state on or after January 1, 2006, that provide reimbursement
  1 33 for immunizations shall provide reimbursement for
  1 34 immunizations containing no more than trace amounts of mercury
  1 35 at the acquisition cost rate for immunizations containing no
  2  1 more than trace amounts of mercury.  For the purposes of this
  2  2 section, "trace amounts" means trace amounts as defined by the
  2  3 United States food and drug administration.
  2  4    2.  For the purposes of this section, "third-party payment
  2  5 provider contracts or policies" includes:
  2  6    a.  Individual or group accident and sickness insurance
  2  7 providing coverage on an expense-incurred basis.
  2  8    b.  An individual or group hospital or medical service
  2  9 contract issued pursuant to chapter 509, 514, or 514A.
  2 10    c.  An individual or group health maintenance organization
  2 11 contract regulated under chapter 514B.
  2 12    d.  An organized delivery system licensed by the director
  2 13 of public health.
