1 4 RELATING TO THE APPOINTMENT OF THE NINTH MEMBER OF THE STATE
1 5 BOARD OF REGENTS.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 262.2, Code 2003, is amended to read as
1 10 follows:
1 11 262.2 APPOINTMENT – TERM OF OFFICE.
1 12 The members shall be appointed by the governor subject to
1 13 confirmation by the senate. Prior to appointing the ninth
1 14 member as specified in section 262.1, the governor shall
1 15 consult with the appropriate student body government at the
1 16 institution at which the proposed appointee is enrolled. The
1 17 term of each member of the board shall be for six years,
1 18 unless the ninth member, appointed in accordance with section
1 19 262.1, graduates or is no longer enrolled at an institution of
1 20 higher education under the board's control, at which time the
1 21 term of the ninth member shall expire one year from the date
1 22 on which the member graduates or is no longer enrolled in an
1 23 institution of higher education under the board's control.
1 24 However, if within that year the ninth member reenrolls in any
1 25 institution of higher education under the board's control on a
1 26 full-time basis and is a student in good standing at either
1 27 the graduate or undergraduate level, the term of the ninth
1 28 member shall continue in effect. The terms of three members
1 29 of the board shall begin and expire in each odd-numbered year
1 30 as provided in section 69.19.
