  1  1    Section 1.  NEW SECTION.  135.146  FIRST RESPONDER
  1  2 VACCINATION PROGRAM.
  1  3    1.  In the event that federal funding as specified in
  1  4 subsection 4 is received, the department shall offer a
  1  5 vaccination program for first responders who may be exposed to
  1  6 infectious diseases when deployed to disaster locations.  For
  1  7 purposes of this section, "first responder" means state and
  1  8 local law enforcement personnel, fire department personnel,
  1  9 and emergency medical personnel who will be deployed to sites
  1 10 of bioterrorism attacks, terrorist attacks, catastrophic or
  1 11 natural disasters, and other disasters.  The vaccinations
  1 12 shall include, but not be limited to, vaccinations for
  1 13 hepatitis B, diphtheria-tetanus, influenza, and other
  1 14 vaccinations when recommended by the United States public
  1 15 health service and in accordance with federal emergency
  1 16 management agency policy.  Immune globulin will be made
  1 17 available when necessary.
  1 18    2.  Participation in the vaccination program shall be
  1 19 voluntary, except for first responders who are classified as
  1 20 having occupational exposure to blood-borne pathogens as
  1 21 defined by the occupational safety and health administration
  1 22 standard contained in 29 C.F.R. } 1910.1030.  First responders
  1 23 who are so classified shall be required to receive the
  1 24 vaccinations as described in subsection 1.  A first responder
  1 25 shall be exempt from this requirement, however, when a written
  1 26 statement from a licensed physician is presented indicating
  1 27 that a vaccine is medically contraindicated for that person or
  1 28 the first responder signs a written statement that the
  1 29 administration of a vaccination conflicts with religious
  1 30 tenets.
  1 31    3.  The department shall establish first responder
  1 32 notification procedures regarding the existence of the program
  1 33 by rule, and shall develop, and distribute to first
  1 34 responders, educational materials on methods of preventing
  1 35 exposure to infectious diseases.  In administering the
  2  1 program, the department may contract with county and local
  2  2 health departments, not-for-profit home health care agencies,
  2  3 hospitals, and physicians.
  2  4    4.  The establishment and continued operation of the
  2  5 program shall be conditioned upon the initial and continued
  2  6 receipt of federal funding or federal grants for administering
  2  7 first responder vaccinations.
  2  8    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  2  9 immediate importance, takes effect upon enactment.  
  2 10                           EXPLANATION
  2 11    This bill provides for the establishment of a vaccination
  2 12 program for first responders.
  2 13    The bill provides that if federal funds or grants to
  2 14 administer the program are received by the Iowa department of
  2 15 public health, the department shall offer a vaccination
  2 16 program for first responders who may be exposed to infectious
  2 17 diseases when deployed to disaster locations.  The bill
  2 18 provides that for the purposes of the vaccination program,
  2 19 "first responder" is defined as including state and local law
  2 20 enforcement personnel, fire department personnel, and
  2 21 emergency medical personnel who will be deployed to sites of
  2 22 bioterrorism attacks, terrorist attacks, catastrophic or
  2 23 natural disasters, and other disasters.  The bill provides
  2 24 that vaccinations to be administered under the program
  2 25 include, but are not limited to, hepatitis B, diphtheria-
  2 26 tetanus, influenza, and other vaccinations recommended by the
  2 27 United States public health service and in accordance with
  2 28 federal emergency management agency policy.  The bill provides
  2 29 that immune globulin will be made available when necessary.
  2 30    The bill provides that the program shall be voluntary,
  2 31 except for first responders who are classified as having
  2 32 occupational exposure to blood-borne pathogens as defined by
  2 33 the occupational safety and health administration standard
  2 34 contained in 29 C.F.R. } 1910.1030.  The bill provides such
  2 35 individuals shall be required to receive the designated
  3  1 vaccinations unless exempt.  The bill provides that a first
  3  2 responder shall be exempt when a written statement from a
  3  3 licensed physician is presented indicating that a vaccine is
  3  4 medically contraindicated for that person or the first
  3  5 responder signs a written statement that the administration of
  3  6 a vaccination conflicts with religious tenets.
  3  7    The bill provides that the department shall establish first
  3  8 responder notification procedures regarding the existence of
  3  9 the program by rule, and shall develop and distribute
  3 10 educational materials on methods of preventing exposure to
  3 11 infectious diseases.  The bill provides that the department
  3 12 may contract with county and local health departments, not-
  3 13 for-profit home health care agencies, hospitals, and
  3 14 physicians in administering the program.
  3 15    The bill takes effect upon enactment.
