PAG LIN 1 1 Section 1. NEW SECTION. 12.67 LITTERING REWARDS FUND. 1 2 A littering rewards fund is established in the state 1 3 treasury, to be administered by the treasurer of state. The 1 4 fund shall consist of moneys allocated to the fund pursuant to 1 5 section 602.8108, subsection 7. Moneys in the fund shall be 1 6 used to provide rewards to persons who report the crimes of 1 7 littering and placing debris on a public highway or in a state 1 8 park. A reward of one hundred dollars shall be paid from the 1 9 moneys in the fund to any person who provides information to a 1 10 law enforcement agency which subsequently leads to the 1 11 conviction of an offender under section 321.369, 321.370, or 1 12 461A.43. In order to receive the reward, a person who 1 13 provides information which leads to the conviction of an 1 14 offender under section 321.369, 321.370, or 461A.43 shall 1 15 provide the treasurer of state a certified document from the 1 16 law enforcement agency stating the person provided information 1 17 which led to the conviction and a certified copy of the court 1 18 order relating to the offender's conviction. 1 19 Sec. 2. Section 602.8108, subsection 2, Code Supplement 1 20 2003, is amended to read as follows: 1 21 2. Except as otherwise provided, the clerk of the district 1 22 court shall report and submit to the state court 1 23 administrator, not later than the fifteenth day of each month, 1 24 the fines and fees received during the preceding calendar 1 25 month. Except as provided in subsections 4,and5, and 7, the 1 26 state court administrator shall deposit the amounts received 1 27 with the treasurer of state for deposit in the general fund of 1 28 the state. The state court administrator shall report to the 1 29 legislative services agency within thirty days of the 1 30 beginning of each fiscal quarter the amount received during 1 31 the previous quarter in the account established under this 1 32 section. 1 33 Sec. 3. Section 602.8108, Code Supplement 2003, is amended 1 34 by adding the following new subsection: 1 35 NEW SUBSECTION. 7. The state court administrator shall 2 1 allocate twenty-five percent of all of the fines attributable 2 2 to littering citations issued pursuant to sections 321.369, 2 3 321.370, and 461A.43 to the treasurer of state for deposit in 2 4 the littering rewards fund established in section 12.67. 2 5 Sec. 4. Section 805.8A, subsection 14, paragraph d, Code 2 6 Supplement 2003, is amended to read as follows: 2 7 d. LITTER AND DEBRIS VIOLATIONS. For violations under 2 8 sections 321.369 and 321.370, the scheduled fine isthirty-2 9fivefive hundred dollars. 2 10 Sec. 5. Section 805.8B, subsection 6, paragraph b, Code 2 11 2003, is amended to read as follows: 2 12 b. For violations under sections 461A.40,461A.43,2 13 461A.46, and 461A.49, the scheduled fine is fifteen dollars. 2 14 Sec. 6. Section 805.8B, subsection 6, Code 2003, is 2 15 amended by adding the following new paragraph: 2 16 NEW PARAGRAPH. e. For violations under section 461A.43, 2 17 the scheduled fine is five hundred dollars. 2 18 EXPLANATION 2 19 This bill relates to littering or placing debris on a 2 20 public highway or state parkland and establishes a fund. 2 21 The bill raises the scheduled fine for littering or placing 2 22 debris on a public highway from $35 to $500. The bill also 2 23 raises the scheduled fine for littering in a state park from 2 24 $15 to $500. 2 25 The bill provides that 25 percent of all fines attributable 2 26 to littering or placing debris citations issued pursuant to 2 27 Code sections 321.369, 321.370, and 461A.43 shall be deposited 2 28 in the littering rewards fund established in the office of the 2 29 state treasurer. A person who reports littering or placing 2 30 debris on a public highway or in a state park which 2 31 subsequently leads to the conviction of an offender under Code 2 32 section 321.369, 321.370, or 461A.43 shall receive a reward of 2 33 $100 from the moneys in the fund. In order to receive the 2 34 reward, a person who provides information which leads to the 2 35 conviction of an offender under Code section 321.369, 321.370, 3 1 or 461A.43 shall provide the treasurer of state a certified 3 2 document from the law enforcement agency stating the person 3 3 provided information which led to the conviction and a 3 4 certified copy of the court order relating to the offender's 3 5 conviction. 3 6 LSB 5597SS 80 3 7 jm/sh/8
