1 1 Section 1. NEW SECTION. 455B.183D WATER QUALITY NEEDS
1 2 AND INFRASTRUCTURE PROGRAM FUND.
1 3 1. A water quality needs and infrastructure program shall
1 4 be implemented and administered by the department. The
1 5 program shall provide financial assistance for the
1 6 administration, regulation, and enforcement of the federal
1 7 Safe Drinking Water Act, source water protection grants, and
1 8 infrastructure loans to water systems.
1 9 2. a. A water quality needs and infrastructure fund is
1 10 created in the state treasury under the control of the
1 11 department. Notwithstanding section 423.2, subsection 10,
1 12 revenues received from the taxation of water pursuant to
1 13 section 423.2, subsection 2, shall be deposited in the water
1 14 quality needs and infrastructure fund. Notwithstanding
1 15 section 8.33, moneys in the water quality needs and
1 16 infrastructure fund at the end of each fiscal year shall not
1 17 revert to any other fund but shall remain in the water quality
1 18 needs and infrastructure fund for expenditure for subsequent
1 19 fiscal years. Notwithstanding section 12C.7, interest or
1 20 earnings on moneys in the water quality needs and
1 21 infrastructure fund shall be credited to the fund.
1 22 b. Within the water quality needs and infrastructure fund,
1 23 the department shall create the following accounts:
1 24 (1) A water quality protection account.
1 25 (2) A drinking water infrastructure revolving loan
1 26 account.
1 27 (3) A source water protection account.
1 28 c. Moneys deposited in the fund pursuant to paragraph "a"
1 29 shall be allocated as follows:
1 30 (1) Ten cents out of each dollar shall be deposited in the
1 31 water quality protection account to be used for purposes of
1 32 enforcing provisions of the federal Safe Drinking Water Act as
1 33 delegated to the state.
1 34 (2) Fifty cents out of each dollar shall be deposited in
1 35 the drinking water infrastructure revolving loan account to be
2 1 used for purposes of providing low-interest loans to public
2 2 water systems and community water systems which can comply
2 3 with or have the potential to comply with the financial,
2 4 technical, and managerial criteria of a viability assessment
2 5 and remain in compliance with requirements of the federal Safe
2 6 Drinking Water Act.
2 7 (3) Forty cents out of each dollar shall be deposited in
2 8 the source water protection account to be used for the purpose
2 9 of building capacity for wellhead and watershed protection
2 10 initiatives.
2 11 Sec. 2. ADVISORY COMMITTEE. The department of natural
2 12 resources shall form an advisory committee for purposes of
2 13 assisting in the development of rules to administer this Act.
2 14 The advisory committee shall assist in the development of
2 15 qualification criteria for the approval of programs and
2 16 projects receiving financial assistance under this Act. The
2 17 advisory committee shall consist of representatives from the
2 18 following entities:
2 19 1. The department of natural resources.
2 20 2. The department of agriculture and land stewardship.
2 21 3. Iowa state university of science and technology.
2 22 4. The college of public health at the state university of
2 23 Iowa.
2 24 5. The Iowa association of municipal utilities.
2 25 6. The Iowa association of water agencies.
2 26 7. The Iowa section of the American water works
2 27 association.
2 28 8. The Iowa rural water association.
2 29 9. The Iowa water pollution control association.
2 30 10. The Iowa league of cities.
2 31 11. The natural resources conservation service.
2 32 EXPLANATION
2 33 This bill creates a water quality needs and infrastructure
2 34 program and fund.
2 35 The bill provides that a water quality needs and
3 1 infrastructure program shall be implemented and administered
3 2 by the department of natural resources to provide financial
3 3 assistance for the administration, regulation, and enforcement
3 4 of the federal Safe Drinking Water Act, and for source water
3 5 protection grants and infrastructure loans to water systems.
3 6 The bill provides that a water quality needs and
3 7 infrastructure fund is created in the state treasury under the
3 8 control of the department and, within the fund, creates a
3 9 water quality protection account, a drinking water
3 10 infrastructure revolving loan account, and a source water
3 11 protection account. The bill provides that revenues from the
3 12 sales tax on the furnishing of water shall be deposited in the
3 13 water quality needs and infrastructure fund instead of the
3 14 general fund of the state.
3 15 The bill provides that 10 cents out of each dollar
3 16 deposited in the fund shall be deposited in the water quality
3 17 protection account to be used for purposes of enforcing
3 18 provisions of the federal Safe Drinking Water Act as delegated
3 19 to the state. The bill provides that 50 cents out of each
3 20 dollar deposited in the fund shall be deposited in the
3 21 drinking water infrastructure revolving loan account to be
3 22 used for purposes of providing low-interest loans to public
3 23 water systems and community water systems which can comply
3 24 with or have the potential to comply with the financial,
3 25 technical, and managerial criteria of a viability assessment
3 26 and remain in compliance with requirements of the federal Safe
3 27 Drinking Water Act. The bill provides that 40 cents out of
3 28 each dollar deposited in the fund shall be deposited in the
3 29 source water protection account to be used for the purpose of
3 30 building capacity for wellhead and watershed protection
3 31 initiatives.
3 32 The bill provides that the department of natural resources
3 33 shall form an advisory committee for purposes of assisting in
3 34 the development of rules to administer the bill. The bill
3 35 provides that the advisory committee shall assist in the
4 1 development of qualification criteria for the approval of
4 2 programs and projects receiving financial assistance under the
4 3 bill.
