  1  1    Section 1.  Section 602.6306, subsection 3, Code 2003, is
  1  2 amended to read as follows:
  1  3    3.  When a district judge is unable to serve as a result of
  1  4 temporary incapacity, a A district associate judge may, by
  1  5 order of the chief judge of the judicial district enrolled in
  1  6 the records of the clerk of the district court, temporarily
  1  7 exercise any judicial authority within the jurisdiction of a
  1  8 district judge during the time of incapacity with respect to
  1  9 the matters or classes of matters specified in that order.  
  1 10                           EXPLANATION
  1 11    This bill relates to the exercise of district judge
  1 12 authority by a district associate judge.
  1 13    The bill provides that the chief judge of a judicial
  1 14 district may order a district associate judge to temporarily
  1 15 exercise judicial authority within the jurisdiction of a
  1 16 district judge.  Current law provides that a chief judge may
  1 17 only order a district associate judge to temporarily exercise
  1 18 judicial authority within the jurisdiction of a district judge
  1 19 upon the incapacitation of a district judge.
