PAG LIN 1 1 Section 1. Section 321.34, Code Supplement 2003, is 1 2 amended by adding the following new subsection: 1 3 NEW SUBSECTION. 24. FINE ARTS PLATES. 1 4 a. Upon application and payment of the proper fees, the 1 5 director may issue fine arts plates to an owner of a motor 1 6 vehicle referred to in subsection 12. 1 7 b. The fine arts plates shall be designed by the 1 8 department in consultation with the department of cultural 1 9 affairs. 1 10 c. The special fee for letter number designated fine arts 1 11 plates is thirty-five dollars. The fee for personalized fine 1 12 arts plates is twenty-five dollars, which shall be paid in 1 13 addition to the special fine arts fee of thirty-five dollars. 1 14 The fees collected by the director under this subsection shall 1 15 be paid monthly to the treasurer of state and credited to the 1 16 road use tax fund. Notwithstanding section 423.24, and prior 1 17 to the crediting of revenues to the road use tax fund under 1 18 section 423.24, subsection 1, paragraph "b", the treasurer of 1 19 state shall transfer monthly from those revenues to the fine 1 20 arts fund created in section 303.90 the amount of the special 1 21 fees collected in the previous month for the fine arts plates. 1 22 d. Upon receipt of the special registration plates, the 1 23 applicant shall surrender the current registration plates to 1 24 the county treasurer. The county treasurer shall validate the 1 25 special registration plates in the same manner as regular 1 26 registration plates are validated under this section. The 1 27 annual special fine arts fee for letter number designated 1 28 plates is ten dollars, which shall be paid in addition to the 1 29 regular annual registration fee. The annual special fee for 1 30 personalized fine arts plates is five dollars, which shall be 1 31 paid in addition to the annual special fine arts fee and the 1 32 regular annual registration fee. The annual special fine arts 1 33 fee shall be credited and transferred as provided under 1 34 paragraph "c". 1 35 Sec. 2. NEW SECTION. 303.90 FINE ARTS FUND. 2 1 1. A fine arts fund is created in the state treasury to be 2 2 administered by the director of the department of cultural 2 3 affairs. The fund shall consist of moneys deposited from fees 2 4 collected for the issuance of fine arts motor vehicle 2 5 registration plates under section 321.34 and any other moneys 2 6 credited to the fund by gift, contribution, endowment, 2 7 bequest, or other means. Moneys in the fund are appropriated 2 8 to the arts division to be used for the purposes described in 2 9 this section. 2 10 2. Notwithstanding section 8.33, moneys remaining in the 2 11 fund at the end of the fiscal year shall not revert to the 2 12 general fund of the state. Notwithstanding section 12C.7, 2 13 subsection 2, interest or earnings on moneys deposited in the 2 14 fine arts fund shall be credited to the fine arts fund. 2 15 3. Moneys in the fund shall be used for grants to Iowa art 2 16 museums to support services and programs as determined by the 2 17 Iowa arts council and to promote the sale of fine arts motor 2 18 vehicle registration plates. 2 19 EXPLANATION 2 20 This bill establishes a special fine arts motor vehicle 2 21 registration plate to be issued by the state department of 2 22 transportation. The plate will be designed by the 2 23 transportation department in consultation with the department 2 24 of cultural affairs. The special fee for initial issuance of 2 25 the plate is $35 for letter number designated plates and $60 2 26 for personalized plates. The annual special fee, to be paid 2 27 in addition to the regular annual registration fee, is $10 for 2 28 letter number designated plates and $15 for personalized 2 29 plates. 2 30 The treasurer of state is directed to transfer the special 2 31 fees from fine arts plates to a new fine arts fund to be 2 32 administered by the director of the department of cultural 2 33 affairs. The purpose of the fund is to provide grants to art 2 34 museums in Iowa, as determined by the Iowa arts council, and 2 35 to promote the sale of special fine arts registration plates. 3 1 LSB 5426SS 80 3 2 dea/gg/14
