  1  4 CONCERNING ELIGIBILITY REQUIREMENTS FOR PAYMENT OF A VOLUNTEER
  1  5    EMERGENCY SERVICES PROVIDER DEATH BENEFIT RESULTING FROM A
  1  6    HEART ATTACK OR STROKE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 100B.11, subsection 2, paragraph b,
  1 11 subparagraph (1), Code Supplement 2003, is amended to read as
  1 12 follows:
  1 13    (1)  (a)  The death resulted from stress, strain,
  1 14 occupational illness, or a chronic, progressive, or congenital
  1 15 illness, including, but not limited to, a disease of the
  1 16 heart, lungs, or respiratory system, unless a traumatic
  1 17 personal injury was a substantial contributing factor to the
  1 18 volunteer emergency services provider's death.
  1 19    (b)  However, if the death was the direct and proximate
  1 20 result of a heart attack or stroke, the volunteer emergency
  1 21 services provider shall be presumed to have died as a result
  1 22 of a traumatic personal injury if the provider engaged in a
  1 23 nonroutine stressful or strenuous physical activity within the
  1 24 scope of the provider's duties and the death resulted while
  1 25 engaging in that activity, while still on duty after engaging
  1 26 in that activity, or not later than twenty-four hours after
  1 27 engaging in that activity, and the presumption is not overcome
  1 28 by competent medical evidence to the contrary.  For purposes
  1 29 of this subparagraph subdivision, "nonroutine stressful or
  1 30 strenuous physical activity" includes, but is not limited to,
  1 31 nonroutine stressful or strenuous physical law enforcement,
  1 32 fire suppression, rescue, hazardous material response,
  1 33 emergency medical services, prison security, disaster relief,
  1 34 emergency response, and training exercise activities.
  1 35 "Nonroutine stressful or strenuous physical activity" does not
  2  1 include activities of a clerical, administrative, or nonmanual
  2  2 nature.
