1 1 Section. 1. NEW SECTION. 461C.3A CURRENT AND FORMER
1 2 OWNERS OF MINING LAND.
1 3 If the owner of land previously used for mining gypsum,
1 4 clay, stone, sand, gravel, coal, or other ores or mineral
1 5 solids is afforded the protections of this chapter with
1 6 respect to a recreational use of the land, a former owner of
1 7 the land shall be afforded the same protections of this
1 8 chapter if the ownership of the land was transferred by the
1 9 former owner to the current owner free and clear of all
1 10 claims, liens, and encumbrances.
1 11 EXPLANATION
1 12 This bill provides that if the owner of land previously
1 13 used for mining gypsum, clay, stone, sand, gravel, coal, or
1 14 other ores or mineral solids is afforded the protections of
1 15 Code chapter 461C with respect to public recreational use of
1 16 the land, a former owner of the land shall be afforded the
1 17 same protections of this Code chapter if the ownership of the
1 18 land was transferred by the former owner to the current owner
1 19 free and clear of all claims, liens, and encumbrances.
