PAG LIN 1 1 Section 1. Section 104A.2, Code 2003, is amended to read 1 2 as follows: 1 3 104A.2 APPLICABILITY REQUIREMENTS. 1 4 1. The standards and specifications adopted by the state 1 5 building code commissioner and as set forth in this chapter 1 6 shall apply to all public and private buildings and 1 7 facilities, temporary and permanent, used by the general 1 8 public, and to public housing buildings. The specific 1 9 occupancies and minimum extent of accessibility shall be in 1 10 accordance with the conforming standards set forth in section 1 11 104A.6. In every public housing building and covered 1 12 multiple-dwelling-unit building containing four or more 1 13 individual dwelling units the requirements of this chapter and 1 14 those adopted by the state building code commissioner shall be 1 15 met. However, this chapter shall not apply to a building, or 1 16 to structures or facilities within the building, if the 1 17 primary use of the building is to serve as a place of worship. 1 18 2. For purposes of this section, "public housing building" 1 19 includes single-family homes, townhouses, duplexes, and other 1 20 buildings with three or fewer dwelling units that are built, 1 21 in whole or in part, with public funds and applies to 1 22 buildings to which a building permit is requested on or after 1 23 July 1, 2003. For purposes of this subsection, "public funds" 1 24 means funding or assistance from the state or any political 1 25 subdivision or instrumentality of the state, through any of 1 26 the following means: 1 27 a. A building contract or similar contractual agreement 1 28 involving a state-funded program or fund. 1 29 b. Any real estate purchase, lease, or donation. 1 30 c. Preferential tax treatment, bond assistance, or any 1 31 other financial assistance. 1 32 d. Disbursement of federal or state construction funds, 1 33 including community development block grants. 1 34 e. A contract to provide funding or a financial benefit 1 35 for housing. 2 1 EXPLANATION 2 2 This bill provides that the building accessibility 2 3 requirements of Code chapter 104A which are a part of the 2 4 state building code and generally applicable to buildings used 2 5 by the general public shall also apply to single-family homes, 2 6 townhouses, duplexes, and other smaller dwelling unit 2 7 buildings that are paid for in whole or in part by public 2 8 funds. The bill defines "public funds" to include assistance 2 9 received from the state or political subdivision of the state 2 10 in the form of financial assistance, real estate purchase or 2 11 transfer, favorable tax treatment, disbursement of federal or 2 12 state construction funds, and public housing assistance. The 2 13 bill provides that the accessibility requirements apply to 2 14 buildings for which a building permit is requested on or after 2 15 July 1, 2003. 2 16 LSB 2690XS 80 2 17 ec/sh/8
