PAG LIN 1 1 SENATE FILE 237 1 2 1 3 AN ACT 1 4 RELATING TO FEES CHARGED TO CERTAIN PRIVATE WATER SUPPLY 1 5 CONTRACTORS, ESTABLISHING A PRIVATE WATER SUPPLY SYSTEM 1 6 ACCOUNT WITHIN THE WATER QUALITY PROTECTION FUND, AND 1 7 APPROPRIATING MONEYS IN THE ACCOUNT. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 455B.183A, subsection 1, Code 2003, is 1 12 amended to read as follows: 1 13 1. A water quality protection fund is created in the state 1 14 treasury under the control of the department. The fund 1 15 consists of moneys appropriated to the fund by the general 1 16 assembly, moneys deposited into the fund from fees described 1 17 in subsection 2, moneys deposited into the fund from fees 1 18 collected pursuant to sections 455B.187 and 455B.190A, and 1 19 other moneys available to and obtained or accepted by the 1 20 department from the United States government or private 1 21 sources for placement in the fund. The fund is divided into 1 22twothree accounts, including the administration account,and1 23 the public water supply system account, and the private water 1 24 supply system account. Moneys in the administration account 1 25shall be usedare appropriated to the department for purposes 1 26 of carrying out the provisions of this division, which relate 1 27 to the administration, regulation, and enforcement of the 1 28 federal Safe Drinking Water Act. Moneys in the public water 1 29 supply system accountshall be usedare appropriated to the 1 30 department to support the program to assist supply systems, as 1 31 provided in section 455B.183B. Moneys in the private water 1 32 supply system account are appropriated to the department for 1 33 the purpose of supporting the programs established to protect 1 34 private drinking water supplies as provided in sections 1 35 455B.187, 455B.188, 455B.190, and 455B.190A. 2 1 Sec. 2. Section 455B.187, Code 2003, is amended by adding 2 2 the following new unnumbered paragraph after unnumbered 2 3 paragraph 2: 2 4 NEW UNNUMBERED PARAGRAPH. The director may charge a fee 2 5 for permits issued pursuant to this section. All fees 2 6 collected pursuant to this section shall be deposited into the 2 7 private water supply system account within the water quality 2 8 protection fund created in section 455B.183A. 2 9 Sec. 3. Section 455B.190A, subsection 5, Code 2003, is 2 10 amended by adding the following new paragraph: 2 11 NEW PARAGRAPH. c. All fees collected pursuant to this 2 12 subsection shall be deposited into the private water supply 2 13 system account within the water quality protection fund 2 14 created in section 455B.183A. 2 15 2 16 2 17 2 18 MARY E.
