PAG LIN 1 1 SENATE FILE 102 1 2 1 3 AN ACT 1 4 RELATING TO THE CHIEF EXECUTIVE OFFICER OF THE IOWA PUBLIC 1 5 EMPLOYEES' RETIREMENT SYSTEM AND PROVIDING AN EFFECTIVE AND 1 6 RETROACTIVE APPLICABILITY DATE. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 97B.3, subsection 1, Code 2003, is 1 11 amended to read as follows: 1 12 1. The administrator of the division is the chief 1 13 executive officer. The chief executive officer shall be 1 14 appointed by the governor subject to confirmation by the 1 15 senate and shall serve a four-year term of office beginning 1 16 and ending as provided in section 69.19. A vacancy shall be 1 17 filled for the unexpired portion of the term in the same 1 18 manner as a full-term appointment is made. The governor may 1 19 remove the chief executive officer for malfeasance in office, 1 20 or for any cause that renders the chief executive officer 1 21 ineligible, incapable, or unfit to discharge the duties of the 1 22 office. The investment board, under the pay plan applicable 1 23 to employees of the division, shall set the salary of the 1 24 chief executive officer. 1 25 Sec. 2. Section 97B.3, Code 2003, is amended by adding the 1 26 following new subsection: 1 27 NEW SUBSECTION. 3. By January 31 of the year in which the 1 28 term of office of the chief executive officer will end, the 1 29 investment board and the benefits advisory committee shall 1 30 submit a written report to the governor and the secretary of 1 31 the senate concerning the board's and committee's evaluation 1 32 of the performance of the chief executive officer, together 1 33 with a recommendation concerning the reappointment of the 1 34 chief executive officer. 1 35 Sec. 3. IPERS CHIEF EXECUTIVE OFFICER TERM OF OFFICE. 2 1 Notwithstanding any provision of section 97B.3 to the 2 2 contrary, the term of office for the chief executive officer 2 3 of the Iowa public employees' retirement system appointed 2 4 prior to the effective date of this Act shall end April 30, 2 5 2008. 2 6 Sec. 4. EFFECTIVE DATE RETROACTIVE APPLICABILITY. This 2 7 Act, being deemed of immediate importance, takes effect upon 2 8 enactment and is retroactively applicable to July 1, 2002, and 2 9 is applicable on and after that date. 2 10 2 11 2 12 2 13 MARY E.
