1 2 SEPSIS CENTRALIZED REPORTING
1 3 Section 1. NEW SECTION. 135.140 SEPSIS CENTRALIZED
1 4 REPORTING EDUCATION.
1 5 1. For the purposes of this division, unless the context
1 6 otherwise requires:
1 7 a. "Department" means the Iowa department of public
1 8 health.
1 9 b. "Director" means the director of public health.
1 10 c. "Sepsis" means a severe illness caused by overwhelming
1 11 infection of the bloodstream by toxin-producing bacteria and
1 12 may include uncomplicated sepsis, severe sepsis, and septic
1 13 shock.
1 14 2. The department shall establish a centralized reporting
1 15 and education program to gather and analyze information
1 16 concerning sepsis, to improve public awareness of sepsis and
1 17 its treatment, and to encourage the timely and appropriate
1 18 prevention, diagnosis, and treatment of sepsis.
1 19 3. a. The department shall establish and maintain a
1 20 process for the collection of data relating to sepsis
1 21 including collection of information necessary to conduct a
1 22 comprehensive epidemiological survey of sepsis and sepsis-
1 23 related diseases in the state and to evaluate the
1 24 appropriateness of measures for the prevention, management,
1 25 and treatment of sepsis.
1 26 b. The department shall adopt rules that require each
1 27 hospital licensed pursuant to chapter 135B to report cases of
1 28 sepsis. The rules shall establish the form, manner, and
1 29 frequency of the reporting. The information to be reported by
1 30 a hospital regarding a case of sepsis shall include but is not
1 31 limited to all of the following:
1 32 (1) The pathological or serological findings.
1 33 (2) The state of the disease.
1 34 (3) Other contributing factors of the disease.
1 35 (4) The methods of treatment utilized.
2 1 (5) Any previous incidence of sepsis in the patient.
2 2 (6) Whether the hospital has a staff physician who
2 3 specializes in critical care medicine.
2 4 (7) The continuing medical education programs provided to
2 5 the medical staff relating to sepsis.
2 6 c. (1) The department shall not reveal the identity of
2 7 any individual who is the subject of the information reported
2 8 by a hospital unless the individual provides prior written
2 9 consent to such disclosure.
2 10 (2) The department may provide information received to
2 11 qualified researchers. The department shall adopt rules to
2 12 establish protocols and fees for the provision of information
2 13 for the purposes of research.
2 14 d. The department shall compile the information reported
2 15 on an annual basis and shall submit a report to the governor
2 16 and to the general assembly by June 1 annually. The report
2 17 shall include a compilation of the information received and
2 18 any recommendations for changes in public policy, medical
2 19 education curricula, hospital staff training, or continuing
2 20 medical education necessary to the prevention, management, and
2 21 treatment of sepsis in the state.
2 22 4. A hospital or other person providing information to the
2 23 department in good faith compliance with this division is
2 24 immune from any liability, civil or criminal, which might
2 25 otherwise be incurred or imposed as a result of the provision
2 26 of information.
2 27 5. The department, in cooperation with the appropriate
2 28 health-related examining boards, shall establish medical
2 29 education and continuing medical education requirements to
2 30 ensure that education addressing critical care issues,
2 31 including the diagnosis and treatment of sepsis, are included
2 32 in the higher education and continuing medical education
2 33 curricula provided in this state.
2 34 EXPLANATION
2 35 This bill directs the Iowa department of public health to
3 1 establish a centralized reporting and education program to
3 2 gather and analyze information concerning sepsis, to improve
3 3 public awareness of sepsis and its treatment, and to encourage
3 4 the timely and appropriate prevention, diagnosis, and
3 5 treatment of sepsis. The bill directs the department to
3 6 establish and maintain a process for the collection of data
3 7 relating to sepsis and to adopt rules that require each
3 8 hospital licensed pursuant to Code chapter 135B to report
3 9 cases of sepsis including specific information relating to
3 10 each case reported. The bill provides for the establishment
3 11 of confidentiality provisions relating to the information
3 12 collected and relating to the sharing of information for the
3 13 purposes of research. The bill directs the department to
3 14 compile the information reported on an annual basis and to
3 15 submit a report to the governor and to the general assembly by
3 16 June 1 annually. The report is to include a compilation of
3 17 the information received and any recommendations for changes
3 18 in public policy, medical education curricula, hospital staff
3 19 training, or continuing medical education necessary to the
3 20 prevention, management, and treatment of sepsis in the state.
3 21 The bill provides immunity from civil and criminal
3 22 liability for a person providing information to the department
3 23 in good faith compliance and directs the department, in
3 24 cooperation with the appropriate health-related examining
3 25 boards, to establish medical education and continuing medical
3 26 education requirements to ensure that education addressing
3 27 critical care issues, including the diagnosis and treatment of
3 28 sepsis, is included in the higher education and continuing
3 29 medical education curricula provided in the state.
