  1  1    Section 1.  NEW SECTION.  22.15  FINANCIAL RECORDS –
  1  2 FOUNDATIONS.
  1  3    1.  As used in this section:
  1  4    a.  "Contribution" means a transfer of money, property, or
  1  5 services, including but not limited to a loan, advance, grant,
  1  6 or gift.
  1  7    b.  "Foundation" means an entity which is not a government
  1  8 body, but which is established by or pursuant to statute or
  1  9 recognized by statute and which has as a purpose providing
  1 10 support to an institution governed by chapter 262.
  1 11    c.  "Personal information" means information which would
  1 12 identify individual contributors or potential individual
  1 13 contributors who have specifically requested confidentiality.
  1 14    2.  Information, other than personal information, stored
  1 15 and preserved by a foundation which relates to the financial
  1 16 condition or affairs of the foundation, including but not
  1 17 limited to its budget, sources of revenue, and expenditures,
  1 18 shall be considered a public record, and the foundation shall
  1 19 be considered a governmental body for purposes of allowing
  1 20 public examination, copying, publishing, or disseminating of
  1 21 the information as provided under this chapter.  A record
  1 22 containing personal information shall not be made public until
  1 23 the personal information is redacted.  In identifying revenue
  1 24 sources, a foundation shall provide information concerning
  1 25 contributions received from individuals by a statement
  1 26 aggregating the amount of contributions made to the foundation
  1 27 by all individuals during the time period covered by the
  1 28 statement.  In identifying revenue sources from contributions
  1 29 received from entities other than individuals, the foundation
  1 30 shall provide, upon request, an itemized statement listing the
  1 31 name of the entity, and the type and amount of contribution
  1 32 received or pledged during the time period covered by the
  1 33 statement.  Personal information obtained prior to the
  1 34 effective date of this Act shall be considered confidential as
  1 35 if confidentiality had been specifically requested at the time
  2  1 that the information was obtained.  
  2  2                           EXPLANATION
  2  3    This bill amends Code chapter 22, the public records law,
  2  4 by adding a new section which provides that financial records
  2  5 of foundations which are established by or pursuant to statute
  2  6 for the support of the board of regents are public records
  2  7 under Code chapter 22.  The bill provides that these
  2  8 foundations must allow public access to information the same
  2  9 as a government body and is subject to all other provisions of
  2 10 Code chapter 22.  The bill also provides that information that
  2 11 would reveal the identity of an individual contributor or
  2 12 potential individual contributor to a foundation, is not
  2 13 public information if the individual requests confidentiality.
  2 14 The bill also provides that individuals who made contributions
  2 15 prior to the effective date of the bill shall be accorded
  2 16 confidentiality as if confidentiality had been specifically
  2 17 requested at the time the contribution was made.
  2 18 Contributions made by entities other than individuals are
  2 19 public information and foundations are required to itemize
  2 20 such contributions by name of the entity, and type and amount
  2 21 of contribution.
