1 4 following:
1 5 "Sec. . NEW SECTION. 668B.4 COMMISSIONER
1 6 REPORT.
1 7 Beginning July 1, 2005, an insurer providing
1 8 medical malpractice insurance coverage in this state
1 9 shall submit an annual report to the commissioner of
1 10 insurance and to the general assembly that shall
1 11 include, but not be limited to, an actuarial valuation
1 12 of the cost savings relating to the cost of medical
1 13 malpractice insurance premiums paid in connection with
1 14 medical malpractice cases pending on the effective
1 15 date of this Act compared to the cost of medical
1 16 malpractice premiums paid in connection with medical
1 17 malpractice cases filed on or after the effective date
1 18 of this Act. Such an annual report shall be required
1 19 until final disposition of all cases pending on the
1 20 effective date of this Act. The cost savings shall be
1 21 returned in the form of refunds to the appropriate
1 22 health care providers in a manner approved by the
1 23 commissioner."
