1 1 Amend Senate File 2262 as follows:
1 2 #1. Page 1, by inserting after line 31 the
1 3 following:
1 4 "2. The department shall not accept, and
1 5 subsection 1 shall not apply to, an application for
1 6 the construction of a structure which is part of an
1 7 open feedlot, unless the application is accompanied by
1 8 an affidavit as provided in this paragraph. The
1 9 affidavit must state that a written notice has been
1 10 delivered to each person residing within one mile of
1 11 the structure constructed as part of the open feedlot.
1 12 The notice shall at least state that a structure is to
1 13 be constructed within one mile of the person's
1 14 residence and that the person may contact the
1 15 department for more information. The notice shall be
1 16 delivered by personal service as in civil actions or
1 17 by restricted certified mail."
